ACTS AMENDMENT (DENTAL
PROSTHETICS STUDENTS) ACT
No. 4 of 1989
AN ACT to amend the Dental Act 1939 and the Dental
Prosthetists Act 1985.
[Assented to 20 April 1989.]
The Parliament of Western Australia enacts as follows:
PART 1—PRELIMINARY
Short title
1. This Act may be cited as the Acts Amendment (Dental Prosthetics
Students) Act 1989.
Commencement
2. This Act shall come into operation on the day on which it receives
the Royal Assent.

PART 2—DENTAL ACT 1939
Section 55 amended
3. Section 55 of the Dental Act 1939* is amended in subsection (1) by
deleting paragraph (d) and substituting the following paragraph-
tt (d) authorize or permit or suffer any person who is not a-
(i) dental attendant;
(ii) dental prosthetics student acting under the direction of a dentist as a requirement for obtaining a qualification prescribed for the purposes of section 18(1) (b) of the Dental Prosthetists Act 1985;
(iii) dental therapist;
(iv) dentist;
(v) medical practitioner; or
(vi) registered nurse,
to assist or take part in any act of dentistry or in any operation on the mouth or in any other dental operation or service; ".

PART 3—DENTAL PROSTHETISTS ACT 1985
Section 4 amended
4. Section 4 of the Dental Prosthetists Act 1985* is amended
| (a) | in subsection (1) by deleting "Nothing" and substituting the following- |
" Subject to subsection (2) (b), nothing "; and
| (b) | by repealing subsection (2) and substituting the following subsection |
(2) Nothing in the Dental Act 1939 applies to or in
relation to the practice of dental prosthetics by
(a) a dental prosthetist to the extent that the dental prosthetist is authorized by a licence to engage in the practice of dental prosthetics; or

(b) subject to section 55 (1) (d) of the Dental Act 1939, a dental prosthetics student as a requirement for obtaining a qualification prescribed for the purposes of section 18(1) (b) of this Act to the extent that the student-
(i) is acting under the direction of a dental prosthetist or a dentist; and
(ii) engages in the practice of dental prosthetics that the dental prosthetist directing the student is authorized by a licence to engage in or, in the case of a dentist directing the student, that the dentist may lawfully engage in. ".
