ACTS AMENDMENT

(CHEMISTRY CENTRE (WA)) ACT

No. 19 of 1990

AN ACT to amend the Fluoridation of Public Water Supplies Act 1966, the Road Traffic Act 1974 and the Veterinary Prepara- tions and Animal Feeding Stuffs Act 1976 and for related purposes.

[Assented to 24 July 1990.1

The Parliament of Western Australia enacts as follows:

PART 1–PRELIMINARY

Short title

1. This Act may be cited as the Acts Amendment (Chemistry Centre (WA)) Act 1990.

Commencement

2.    This Act shall come into operation on such day as is fixed by

proclamation.

PART 2–FLUORIDATION OF PUBLIC WATER SUPPLIES ACT 1966

Principal Act

3. In this Part the Fluoridation of Public Water Supplies Act 1966*

is referred to as the principal Act.

Section 5 amended

4.

Section 5 of the principal Act is amended in subsection (2) by deleting paragraph (d) and substituting the following paragraph

(d) one shall be the Director of the Chemistry Centre (WA) or an analyst from the Chemistry Centre (WA) nominated by the Director; ".

Section 15 amended

5.

Section 15 of the principal Act is amended in subsection (3) by deleting "person for the time being employed in the Public Service of the State as Director (Government Mineralogist, Analyst) of the Government Chemical Laboratories" and substituting the following-

"

Director of the Chemistry Centre (WA) ".

Saving of certificates

A certificate given under section 15 of the principal Act that purports to have been signed by the Director (Government Mineralogist, Analyst) of the Government Chemical Laboratories before the com- mencement of this Act shall continue to have effect as if this Act had not come into operation.

PART 3—ROAD TRAFFIC ACT 1974

Principal Act

7. In this Part the Road Traffic Act 1974* is referred to as the

principal Act.

References to "Government Chemical Laboratories" amended

The principal Act is amended by deleting "Government Chemical

Laboratories" wherever it occurs in the provisions referred to in the

Table to this section and substituting in each case the following-

Saving of certificates and labels

A certificate or label issued under the principal Act that purports to have been signed by the director of the Government Chemical Laboratories or prepared by the Government Chemical Laboratories before the commencement of this Act shall continue to have effect as if this Act had not come into operation.

Validation

10.

Every act or thing purporting to have been done by the Director or any other officer of the Chemistry Centre (WA) under the principal Act before the commencement of this Act that would have been lawful if this Act had been in force at the time when it was done is hereby validated and declared to have been lawfully done.

PART 4—VETERINARY PREPARATIONS AND ANIMAL FEEDING

STUFFS ACT 1976

Principal Act

In this part the Veterinary Preparations and Animal Feeding Stuffs Act 1976* is referred to as the principal Act.

Section 17 amended

Section 17 of the principal Act is amended in subsection (6) in

paragraph (a) by deleting "Government Chemical Laboratories" and

substituting the following

Saving of approved methods of analysis

13.

A method of analysis of samples that is, immediately before the commencement of this Act, a method approved by the director of the Government Chemical Laboratories under the principal Act, shall upon the commencement of this Act be deemed to be a method that has been approved by the Director of the Chemistry Centre (WA), until such time as the Director of the Chemistry Centre (WA) directs otherwise.
