ACTS AMENDMENT

(BETTING CONTROL).

No. 34 of 1985.

AN ACT to amend the Betting Control Act 1954 and to repeal section 9 of the Anzac Day Act 1960.

[Assented to 24 April 1985.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent

of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

PART I.-PRELIMINARY.

1.    This Act may be cited as the Acts Amendment Short title.

PART II.-BETTING CONTROL ACT 1954.

Principal

Act.	3.	In this Part the Betting Control Act 1954 is

Section 5

amended. 4. Section 5 of the principal Act is amended in

subsection (1) by deleting paragraph (a) and

substituting the following paragraph-

(a) on a race course

(1) during the holding at the race

course of a race meeting; or

(ii) in the case of a race meeting held at the race course on Anzac Day, during the period commencing at 12 noon on Anzac Day and ending at the completion of that race meeting;

amended. 5. Section 12 of the principal Act is amended in subsection (3) by deleting "only during the holding of a race meeting at the race course." and substituting the following

only

(a)	during the holding of a race meeting at the race course; or
(b)	in the case of a race meeting held at the race course on Anzac Day, during the period commencing at 12 noon on Anzac Day and ending at the completion of that race meeting. ".

Section 13

amended. 6. Section 13 of the principal Act is amended in subsection (4) by deleting "the hour of one o'clock in the afternoon" and substituting the following-

" 12 noon ".

Section 23

7. Section 23 of the principal Act is amended in amended.

subsection (1) by deleting paragraph (a) and

substituting the following paragraph-

[[ (a) unless the place is registered under this Act as registered premises, or is a race course and then only while-

(i) a race meeting is being held at the race course by the Western Australian Greyhound Racing Association or under permit or licence issued under Part VI of the Western Australian Greyhound Racing Association Act 1981 or under the Racing Restriction Act 1917; or

(ii)    in the case of a race meeting held at the race course within the meaning of subparagraph (i) on Anzac Day, a bookmaker is permitted by section 12 (3) to bet or carry on business as such at the race course on Anzac Day;

or ".

8. Section 27 of the principal Act is amended by	amended.
