ACTS AMENDMENT AND REPEAL

(FAIR TRADING) ACT

No. 17 of 1988

AN ACT to amend the Consumer Affairs Act 1971 and to repeal

Part VIII of the Factories and Shops Act 1963, the Clothes

and Fabrics (Labelling and Sales) Act 1973, the Pyramid Sales Schemes Act 1973, the Trade Descriptions and False Advertisements Act 1936 and the Unsolicited Goods and Services Act 1973.

The Parliament of Western Australia enacts as follows:

PART 1—PRELIMINARY

Short title

1. This Act may be cited as the Acts Amendment and Repeal (Fair

Trading) Act 1988.

Commencement

2.    This Act shall come into operation on a day to be fixed by

proclamation.

PART 2—CONSUMER AFFAIRS ACT 1971

Principal Act

3.    In this Part, the Consumer Affairs Act 1971* is referred to as the

principal Act.

Section 18 amended

4.     Section 18 of the principal Act is amended in subsection (1) by

deleting "five thousand dollars" and substituting the following-

" $40 000 ".

General amendment

The principal Act is amended in the provisions specified in the Table to this section by inserting after "this Act" in each case the following-

" or the Fair Trading Act 1987 ".

Sections 19 (1), (1c), (1d) and (2) (a), 20 (2), 21 (2) (a) and (b), and 23.

PART 3—FACTORIES AND SHOPS ACT 1963

Part VIII repealed

6.    Part VIII of the Factories and Shops Act 1963* is repealed.

7. The Acts specified in the Schedule to this Act are repealed.
