An Act to amend the ACTION Authority Act 2001

Notified under the Legislation Act 2001 on 20 December 2001


(see Legislative Assembly for the Australian Capital Territory enacts as follows:

  1. Name of Act

    This Act is the ACTION Authority Amendment Act 2001.

  2. Commencement

  3. This Act (other than section 5) commences on its notification day.

  4. Section 5 commences, or is taken to have commenced, on the commencement of the ACTION Authority Act 2001, section 4.

  5. Act amended

    This Act amends the ACTION Authority Act 2001.

  6. New section 35A

    insert

35ARegulation-making power

The Executive may make regulations for this Act.

Note Regulations must be notified, and presented to the Legislative Assembly, under the Legislation Act 2001.

  1. New section 36A

    insert

36ATransferred staff

  1. This section applies to a person who was—

    (a)immediately before the commencement day a public servant employed or performing duties in the business unit known as ACTION in the Department of Urban Services; and

    (b)mentioned in an instrument under section 22 (1) (Former public servants); and

    (c)mentioned in an instrument under section 36 (1) as being a person who is transferred to the authority.

  2. For this Act, the person is taken to be a transferred employee under section 22 and an employee of the authority from the commencement day.

  3. New section 40

  4. Expiry of pt 6

  5. This part expires on 31 December 2003.

  6. To prevent doubt, it is declared that the Legislation Act 2001, section 88 (Repeal does not end transitional or validating effect etc) applies to part 6.
