Acoustic Laboratories Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Acoustic Laboratories Act 1948.

Commencement

1. These Regulations commence on 1 January 1990.

2. Regulations 2 and 3 of the Acoustic Laboratories Regulations are repealed and the following regulations and Schedule substituted:

Interpretation

"2. In these Regulations:

'acousticlaboratory'means an acoustic laboratory controlled by the Secretary.

Charges to be made for certain audiometric tests

"3. A charge of $60 is payable for each hour or part of an hour in which audiometric testing is conducted at an acoustic laboratory as part of the medical examination of a person:

(a) who is an applicant for the grant or renewal under the Civil Aviation Regulations of:

(i) a commercial pilot licence; or

(ii) a senior commercial pilot licence; or

(iii) a second class airline transport pilot licence; or

(iv) a first class airline transport pilot licence; or

(v) a flight navigator licence; or

(vi) a flight radiotelephone operator licence; or

(vii) a flight radiotelegraph operator licence; or

(viii) a flight engineer licence; or

(b) for the purposes of medical treatment within the meaning of the Commonwealth Employees' Rehabilitation and Compensation Act 1988.

Fees for services provided at acoustic laboratories

"4. (1) The charge for use of a room of an acoustic laboratory, being a room of a kind that is specified in column 2 of an item in the Schedule is:

(a) in the case of use for more than 3 days—the amount specified in column 3 of the item for each hour or part of an hour of use; and

(b) in any other case—the amount specified in column 4 of the item for each hour or part of an hour of use.

"(2) The charge for use of an instrument in a test at an acoustic laboratory is:

(a) in the case of an instrument the value of which does not exceed $40,000—$13 for each hour or part of an hour of use; and

(b) in any other case—$25 for each hour or part of an hour of use.

"(3) The charge for the provision of assistance given by a member of the staff of an acoustic laboratory in the use of a room referred to in subregulation (1) or in the use of an instrument referred to in subregulation (2) is $64 for each hour or part of an hour of assistance.

"(4) The charge for a test of a hearing protector conducted at an acoustic laboratory is:

(a) in the case of a test of 1 hearing protector—$4,400; and

(b) in the case of a test of 2 hearing protectors at the same time— $2,200 for each protector; and

(c) in the case of a test of 3 hearing protectors at the same time— $1,466 for each protector; and

(d) in the case of a test of 4 hearing protectors at the same time— $1,100 for each protector.

"(5) For the purposes of subregulation (2), the value of an instrument is the cost of the instrument at the time of its acquisition for use at an acoustic laboratory.

Payment of charges and reduction in payment

"5. (1) A charge under these Regulations is payable by the person at whose request the charge was incurred and may be recovered from the person as a debt due to the Commonwealth.

"(2) A charge for a service that is payable by:

(a) an authority or agency of the Commonwealth or of a State or Territory; or

(b) a body corporate, other than a trading corporation, that receives all of its income from an authority or agency referred to in paragraph (a); or

(c) an educational institution;

is payable at 75% of the rate specified in regulation 4 for the service.".
