Acoustic Laboratories Regulations 2(Amendment)

  

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Acoustic Laboratories Act 1948.

1.   Commencement

1.1   These Regulations commence on 1 April 1991.

  

2.   Amendment

2.1   The Acoustic Laboratories Regulations are amended as set out in these Regulations.

  

3.   Regulation 2 (Interpretation)

3.1   Insert the following definition:

‘government agency’ means:

 (a) the Commonwealth or a State or Territory or a public authority of the Commonwealth or of a State or Territory; or

  • (b)

    a body corporate:

     (i) in which the Commonwealth or a State or Territory or a public authority referred to in paragraph (a) has an interest and that interest is or, if there is more than 1 interest of that kind, those interests together are, the controlling interest in the body; and

     (ii) that is not a public authority of that kind.”.

  

4.   Regulation 3 (Charges for certain audiometric tests)

4.1   Omit “$60”, substitute “$75”.

 

4.2   Add at the end:

  • “;or (c)

    who is referred to the laboratory in the course of the provision of rehabilitation services by the Commonwealth to that person under Part III of the Disability Services Act 1986  in relation to an incapacity, or possible incapacity, in respect of which a worker’s compensation payment is, or may be, made to the person.

 “(2)

A charge of $25 is payable for audiometric testing, other than testing to which subregulation (1) applies, conducted at an acoustic laboratory in respect of a person who:

  • (a)

    constitutes, or is a member of, a public authority of the Commonwealth or of a State or Territory; or

  • (b)

    is a director or an officer or employee of a government agency.

 “(3)

In paragraph (1) (c), ‘worker’s compensation payment’ means a payment that is, or would be, made within or outside Australia wholly or partly as compensation for injury at, or disease or disability caused by, work:

 (a) by way of damages; or

 (b) under a scheme of compensation or insurance provided for by a law of the Commonwealth (other than the law specified in paragraph (1) (b)) or of a State or Territory, including a payment under a contract entered into pursuant to such a scheme; or

 (c) whether with or without admission of liability, in settlement of a claim under a scheme of that kind or of a claim for damages;

other than a payment under a contract of insurance to which the person is a party”.

  

5.   Regulation 4 (Charges for services provided at acoustic laboratories)

5.1   Paragraph 4 (2) (a):

Omit “$13”, substitute “$14”.

 

5.2   Paragraph 4 (2) (b):

Omit “$25”, substitute “$27”.

 

5.3   Subregulation 4 (3):

Omit “$64”, substitute “$75”.

 

5.4   Paragraph 4 (4) (a):

Omit “$4,400”, substitute “$4,725”.

 

5.5   Paragraph 4 (4) (b):

Omit “$2,200”, substitute “$2,362”.

 

5.6   Paragraph 4 (4) (c):

Omit “$1,466”, substitute “$1,674”.

 

5.7   Paragraph 4 (4) (d):

Omit “$1,100”, substitute “$1,180”.

  

6.   New regulation 4a

6.1   After regulation 4, insert:

Charges for certain calibration services

“4a. (1)  The charges in respect of the calibration of an item of equipment at an acoustic laboratory are:

(a) for the preliminary service of ascertaining whether repairs are necessary to make the equipment functional and how the equipment functions—$45; or

  • (b)

    for the aural and visual examination of the equipment and the checking of the accuracy of frequency and level control and of the calibration of hearing level accuracy—$70; or

  • (c)

    for the service referred to in paragraph (b), together with the calibration of bone conduction level—$100.

 “(2)

The fee for all services in respect of the calibration of an item of equipment at an acoustic laboratory, other than the services prescribed in subregulation (1), is $60 for each hour or part of an hour in which the services are provided.”.

 

7.   Regulation 5 (Payment of charges and reduction in payment)

7.1   Subregulation 5 (2):

Omit the subregulation, substitute:

“(2)

A charge for a service to which regulation 4 applies that is payable by:

  • (a)

    a government agency; or

  • (b)

    a body corporate, other than a trading corporation, that receives all of its income from a government agency; or

    • (c)

      an educational institution;

is payable at 75% of the rate prescribed in that regulation for the service.”.

  

8.   Schedule (Fees)

8.1   Omit the Schedule, substitute:
