Application for approval of the TWU-ACFS Port Logistics Pty Ltd Fair Work Agreement 2015.

[1] An application has been made for approval of an enterprise agreement known as the TWU-ACFS Port Logistics Pty Ltd Fair Work Agreement 2015 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by ACFS Port Logistics Pty Limited. The Agreement is a single-enterprise agreement.

[2] The Transport Workers’ Union of Australia, being a bargaining representative for the Agreement, has given notice under s.183 of the Act that they want the Agreement to cover them. In accordance with s.201(2), I note that the Agreement covers this organisation.

[3] The Agreement shall be read in conjunction with the terms of the Road Transport and Distribution Award 2010. The Award is incorporated into and forms part of this Agreement.

[4] I am satisfied that each of the requirements of ss.186, 187 and 188 of the Act, as are relevant to this application for approval, have been met.

[5] The Agreement is approved and, in accordance with s.54 of the Act, will operate from 7 days after the agreement is approved, that is, 26 April 2016. The nominal expiry date of the Agreement is 31 August 2017.
