An Act to Transfer to and Vest in The University of 5 E gE Queensland, the Lands and other Property LION SOCIETY of The Acclimatisation Society of Queensland. TiMate% OF 1956. [ASSENTED TO 23RD NOVEMBER, 1956.] W HEREAS a Society of persons known as The Preamble. Acclimatisation Society of Queensland, also known as and otherwise called The Queensland Acclimatisation Society, has heretofore been formed and now exists in the State of Queensland: AND WHEREAS in the year one thousand nine hundred and forty-one the freehold land described in the Schedule to this Act was, by Nomination of Trustees registered in the office of the Registrar of Titles at Brisbane as Number A 501152, transferred to and vested in and held by Trustees upon the following trusts, namely :— "Upon Trust for 'The Acclimatisation Society of Queensland' and upon further trust to lease, sell, or mortgage the said lands, or any part thereof, as they may from time to time be required by the Council for the time being of the said 'The Acclimatisation Society of Queensland' and the proceeds of all such sales, and the moneys borrowed on all such mortgages shall be paid to the said 'The Acclimatisation Society of Queensland' or as they may direct " : AND WHEREAS in the year one thousand nine hundred and fifty-five, consequent upon the death of one of the Trustees, an Appointment of a New Trustee of the land described in the Schedule to this Act was duly registered in the office of the Registrar of Titles at Brisbane as Number B 345563: AND WHEREAS, with the development of agriculture, the functions of the Society have passed, to a large extent, to governmental and semi-governmental organisations:

II., AND WHEREAS the Society is now faced with diminution of its assets without commensurate returns and with increasing difficulty in the achievement, consistent with its objects, of anything of lasting value: AND WHEREAS at a properly convened special general meeting of the Society held at Brisbane in the © State of Queensland, on the twelfth day of April, one thousand nine hundred and fifty-six, the following resolution was duly passed :— "It is the opinion of this meeting that the best method of ensuring that the assets of the Society are devoted to the furthering of its objective would be to hand over these assets to The University of Queensland" : AND WHEREAS it is the desire of the Society that the land and other property to be transferred shall, as far as practicable, be applied for the furtherance of the study and teaching of applied botany and zoology, and more particularly with reference to problems affecting the agriculture of the State of Queensland: AND WHEREAS the Society and the University are now desirous that the said land together with the improvements thereon and all other property of the Society be transferred to the University: AND WHEREAS it is desirable to effect such transfer: Be it therefore enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- Short title. 1. This Act may be cited as " The Acclimatisation Society of Queensland Transfer Act of 1956." Interpreta- tion. 2. In this Act, the following terms shall have the meanings respectively assigned to them, that is to say— " Society " means The Acclimatisation Society of Queensland, also known as and otherwise called The Queensland Acclimatisation Society; " University " means The University of Queensland, the body corporate established and constituted by *" The University of Queensland Acts, 1909 to 1941." * 9 E. 7 No. 7 and amending Acts.

Upon the passing of this Act, the freehold Property land described in the Schedule to this Act and all other aAcTota. property of the Society shall, as from the date of such tisation passing, by virtue of this Act, without any transfer, tlentyslaonfd conveyance, or assignment, except as otherwise provided transferred in this section, be divested from the Trustees of the t;Lheersity of same and the objects of the Trusts created in respect Queensland. thereof, and vest in the University for the purposes of the University, completely freed and discharged from the trusts upon and subject to which the said land and other property have heretofore been held. (2.) The surviving Trustees under the said Nomination of Trustees and the said Appointment of New Trustee of the land described in the Schedule to this Act may (and are hereby authorised to) transfer to the University, the estate in fee simple in the said land to be held by the University absolutely for the purposes of the University, completely freed and discharged from the trusts upon and subject to which that land has heretofore been held. by v4ir.tuAenoyf pthroispAerctyt swhhailclhbeissvoevsteesdteidn sthuebjUecntivtoerasintyy l E ia x b is il t i i t n ie g s. debt, liability, or obligation specially charged on or affecting the same including any debt, liability, or obligation incurred by the Society in furtherance of its objects, and subsisting at the date of the passing of this Act. On and after the date of the passing of this Act neither the Society nor the Trustees thereof shall be subject to any liability in respect of any debt, liability, or obligation in this section mentioned, and every such liability shall, on and after such date and to the extent of such property and no more, be imposed on and discharged by the University. SCHEDULE. All that piece of land situated in the County of Stanley, Parish of Redland, described as Subdivisions 16A and 17A of Section 7 of Portion 1 containing an area of nine (9) acres three (3) roods twenty-seven (27) perches (be the same a little more or less) being the whole of the land contained in Certificate of Title Number 416123 Volume 2166 Folio 113.
