Accident Compensation (Consequential

Amendment) Regulations 1999

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to make amendments to the Principal Regulations consequential upon the passage of the Accident Compensation (Amendment) Act 1998 and in relation to certain prescribed allowances under the Accident Compensation Act 1985.

2. Authorising provision

These Regulations are made under section 253 of the Accident Compensation Act 1985.

3. Commencement

(1) Regulations 1, 2, 3, 4, 5, 6, 9 and 10 come into

operation on the day these Regulations are made.

(2) Regulations 7 and 8 come into operation on the

date of commencement of Part 2 of the Accident

Compensation (Amendment) Act 1998.

4. Principal Regulations

In these Regulations, the Accident Compensation
Regulations 19901 are called the Principal

Regulations.

5. Travelling allowance

In regulation 6 of the Principal Regulations, for

"40 cents" substitute "53·5 cents".

6. Accommodation allowance

In regulation 7 of the Principal Regulations, for

"$100.00" substitute "$130.00".

7. Investigation of fraud

In regulation 13 of the Principal Regulations, for
"authorised insurers" substitute "persons who
were authorised insurers before the
commencement of Part 2 of the Accident

Compensation (Amendment) Act 1998".

8. Removal of references to "authorised insurers"

(1) In regulation 14A(1) of the Principal Regulations,

omit "or an authorised insurer".

(2) In regulation 17 of the Principal Regulations, omit

", authorised insurer" where twice occurring.

(3) In regulation 18(4) of the Principal Regulations,

omit "or authorised insurer" where twice

occurring.

(4) In regulation 23 of the Principal Regulations, omit

", authorised insurer" where twice occurring.

(5) In regulation 25 of the Principal Regulations, omit

", authorised insurer".

(6) In regulation 25A of the Principal Regulations,

omit "or authorised insurer" where twice

occurring.

9. Deletion of redundant forms

In Schedule 7 to the Principal Regulations, Form
4 and Form 4A are revoked.

10. Form of Warrant under section 240A of the Accident Compensation Act 1985

In the form of Search Warrant in Schedule 8 to the
Principal Regulations, in the paragraph
immediately following the heading
"AUTHORITY", for "are being contravened",

substitute "are being or have been contravened".
