Access Licence Dealing Principles (Upper Lachlan Alluvial Zone 1

Management Zone) Order 2020

in pursuance of section 71Z of the Water Management Act 2000, make the following Order.

Explanatory note

The object of this Order together with the Temporary Water Restriction (Upper Lachlan Alluvial Zone 1 Management Zone) Order 2020 is to impose a take and trade cap within the Upper Lachlan Alluvial Zone 1 Management Zone of the Upper Lachlan Alluvial Groundwater Source to limit total extraction from the management zone to 30% of the total share components of access licences under which take occurs within the management zone.

This Order is made under section 71Z of the Water Management Act 2000.

1           Name of Order

This Order is the Access Licence Dealing Principles (Upper Lachlan Alluvial Zone 1 Management

Zone) Order 2020.

2           Commencement

This Order commences the day on which it is published on the NSW legislation website.

3           Duration

This Order will remain in force until the day on which the Section 324 Order expires or is repealed.

Note. The Section 324 Order expires on 1 July 2021.

4           Dealing prohibition

(1) An assignment of water allocations under section 71T of the Act from an aquifer access
licence under which water is taken from the Upper Lachlan Alluvial Zone 1 Management
Zone within the Upper Lachlan Alluvial Groundwater Source is not permitted if, as a result of
the assignment, the total volume of water allocations assigned from the access licence within
the water year is more than the sum of the following:
(a) 0.3 megalitres per unit share of the access licence share component,

(b)

minus the water allocations taken from the Upper Lachlan Alluvial Zone 1 Management Zone under the access licence within the water year,

(c) plus the water allocations assigned to the access licence within the water year.
(2) For the avoidance of doubt, this Order prevails to the extent of any inconsistency with the
Access Licence Dealing Principles Order 2004 or the access licence dealing rules under the
Water Sharing Plan for the Lachlan Alluvial Groundwater Sources 2020.
5 Interpretation
(1) In this Order:
Section 324 Order means the Temporary Water Restriction (Upper Lachlan Alluvial Zone 1
Management Zone) Order 2020.
Upper Lachlan Alluvial Groundwater Source has the same meaning as in the Water Sharing
Plan for the Lachlan Alluvial Groundwater Sources 2020.
Upper Lachlan Alluvial Zone 1 Management Zone has the same meaning as in the Water
Sharing Plan for the Lachlan Alluvial Groundwater Sources 2020.
(2) Unless otherwise defined, words and expressions that are defined in the Water Management
Act 2000 or in regulations made under that Act have the same meaning in this Order.
