PURSUANT to section 71Z of the Water Management Act 2000, I, DAVID HARRISS, as
delegate for the Minister for Water, make the following Access Licence Dealing Principles

Amendment Order (Water Tagging Zones) 2010.

Explanatory note

Section 71Z of the Water Management Act 2000 provides that the Minister may, at
any time, by order published on the NSW legislation website, establish access
licence dealing principles. The purpose of this Order is to amend the Access Licence

Dealing Principles Order 2004.

1 Name of Order

This Order is the Access Licence Dealing Principles Amendment Order (Water

Tagging Zones) 2010.

2 Commencement

This Order commences on the day on which it is published on the NSW legislation website.

3 Amendment

The Access Licence Dealing Principles Order 2004 is amended as set out in
Schedule 1.

[1]        Clause 20(10)

Omit paragraph (10). Insert instead:

(10)

Dealings under section 71W which involve the nomination, or the withdrawal of any such nomination, of water supply works in a NSW water tagging zone or an interstate water tagging zone, except as provided by subclause (11),

must be assessed in accordance with the rules applying from time to time
under Schedule D of the Murray Darling Basin Agreement as set out in

Schedule 1 of the Commonwealth Water Act 2007.

(11) Dealings under section 71W which involve the nomination, or the withdrawal
of any such nomination, of water supply works in an interstate water tagging
zone established for the Border Rivers Catchment must be assessed in
accordance with the rules applying from time to time under Schedule E and its
related Appendix E1 of the New South Wales-Queensland Border Rivers
Intergovernmental Agreement 2008.

Note. The New South Wales-Queensland Border Rivers Intergovernmental Agreement 2008 relates to
the Border Rivers Catchment. A map of the Border Rivers Catchment is shown in Schedule C to the

Agreement.

Omit paragraph (1). Insert instead:
(1) The following interstate water tagging zones are established as interstate
water tagging zones for the purposes of section 71W of the Act:
(a) the interstate water tagging zones which are approved from time to time in the Protocols made under Schedule D of the Murray-Darling Basin Agreement as set out in Schedule 1 to the Commonwealth Water Act 2007;
(b) the acceptable stream sections which are approved from time to time in Schedule E of the New South Wales-Queensland Border Rivers Intergovernmental Agreement 2008.
