Explanatory note

This Order amends the Access Licence Dealing Principles Order 2004 to permit an access licence held by Essential Energy to be amended to nominate a water supply work in any part of the Murray Water Source. This is to enable Essential Energy to take water under the Murray to Broken Hill pipeline project to provide town water supplies to Broken Hill. This Order is made under section 71Z of the Water Management Act 2000, in particular section 71Z (1) (b).

1              Name of Order

This Order is the Access Licence Dealing Principles Amendment Order (Broken Hill Pipeline) 2018.

2              Commencement

This Order commences on the day on which it is published on the NSW legislation website.

3            Amendment

This Order amends the Access Licence Dealing Principles Order 2004 as set out in Schedule 1.

4            Interpretation

Unless otherwise defined, words and expressions that are defined in the Water Management Act 2000 or in regulations made under that Act have the same meaning in this Order.

Clause 20 Nomination of water supply works

Insert at the end of clause 20 (4) (b):

(c) if the holder of the access licence is Essential Energy and the water supply work to be nominated on that licence is located in any part of the Murray Water Source (as defined in the Water Sharing Plan for the New South Wales Murray and Lower Darling Regulated River Water Sources 2016).
