Explanatory note

This Order amends the Access Licence Dealing Principles Order 2004 for the following purposes:

(a)	to ensure dealings with respect to the nomination of extraction points are prohibited and regulated in the same way (where relevant) as dealings with respect to the nomination of water supply works.
(b)	to ensure that the nomination of water supply works and extraction points can be made for specific purpose access licences, local water utility access licences and access licences of the subcategory town water supply subject to certain limitations.

This Order is made under section 71Z of the Water Management Act 2000, in particular section 71Z
(1) (b).

1              Name of Order

This Order is the Access Licence Dealing Principles Amendment (Nomination of Water Supply Works

and Extraction Points) Order 2018.

2              Commencement

This Order commences on 1 December 2018.

3            Amendment

This Order amends the Access Licence Dealing Principles Order 2004 as set out in Schedule 1.

Schedule 1 Amendment of Access Licence Dealing Principles Order 2004

[1] Clause 20 Nomination of water supply works and extraction points

Omit “nomination of water supply works” from clause 20 (1).

[2] Clause 20 (2), (3), (4), (10) and (11)

Omit “under section 71W” wherever occurring. Insert instead “to which this clause applies”.

[3] Clause 20 (3)

Omit “with the following exceptions”. Insert instead “unless”.

[3] Clause 20 (3) (a)

Omit “if”.

[4] Clause 20 (3) (b)

Omit. Insert instead:

(b) all works, or extraction points, nominated by the licence would only supply the same property or contiguous properties that are owned or occupied by the same landholder, or

[5] Clause 20 (4) (a)

Omit. Insert instead:

(a) (Repealed)

[6] Clause 20 (4) (b)

Insert “or extraction point” after “nominated work” wherever occurring.

[7] Clause 20 (9)

Omit “the other parts of”.

[8] Clause 20 (9)

Omit “these” after “regulate”.

[9] Clause 20 (9)

Insert “to which this clause applies” before “provided”.

Insert “or extraction points” after “water supply works” wherever occurring.
