  1. In light of the findings and conduct of the proceedings below, the application does not present an occasion to consider the issue of principle identified in the second of the applicant's proposed grounds.  An appeal to this Court would enjoy insufficient prospects of success to warrant the grant of special leave.  Special leave should be refused.

  2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
