Application for approval of the ABSOLUTE COMMISSIONING GROUP PTY LTD WestConnex 3A & ETU Greenfields Project Agreement 2022 - 2023
An application has been made for approval of an enterprise agreement known as the ABSOLUTE COMMISSIONING GROUP PTY LTD WestConnex 3A & ETU Greenfields Project Agreement 2022 - 2023 (the Agreement) pursuant to s.182(4) of the Fair Work Act 2009 (the Act) by Absolute Commissioning Group Pty Ltd. The agreement is a single enterprise agreement that is a greenfields agreement.
The matter was allocated to my Chambers on 15 March 2022.
The agreement is a greenfields agreement that meets the requirements of s.172(2)(b) of the Act.
In accordance with s.187(5)(a) of the Act, I am satisfied that the Communications Electrical Electronic Energy Information Postal Plumbing and Allied Services Union of Australia (CEPU) is entitled to represent the industrial interests of a majority of employees who will be covered by the Agreement in relation to the work that is to be performed under it.
Pursuant to s.53(2)(b) of the Act I note that the Agreement was made with the Communications Electrical Electronic Energy Information Postal Plumbing and Allied Services Union of Australia (CEPU) and that the Agreement covers this organisation.
On 16 March 2022, my Chambers sent correspondence to the parties seeking to address concerns with certain aspects of the Agreement and invited the parties to address these matters. The concerns were as follows:
· Chambers sought confirmation as to the date the agreement was made to ensure the pre-approval requirements at section 185(4) of the Act have been met. The Applicant submitted an amended Form F20 which confirmed that the Agreement was made on 2 March 2022 which is consistent with the Act.
· The parties were notified that the agreement contains deductions at clause 34(b) regarding overpayment of wages and at clause 49(e) regarding protective clothing on termination that may not be permitted deductions pursuant to s.324 of the Act and may not be enforceable upon approval of the Agreement.
· Clause 20 relating to compassionate leave and clause 25(a) relating to community service leave may not be consistent with the National Employment Standards (NES) however the NES precedence term at clause 9(b) of the Agreement is deemed to resolve these NES concerns.
· Chambers raised better off overall concerns relating to trainees, the minimum engagement of casual employees and the safeguards for part-time employees.
The Applicant has submitted an undertaking in the required form dated 23 March 2022. The undertaking deals with the following topics:
· A casual employee must be engaged and paid for at least 2 consecutive hours of work on each occasion they are required to attend work.
· Notwithstanding clause 15(d), all additional hours worked by part-time employees beyond ordinary hours established under clause 8.5(d) each week and all hours worked outside the span of ordinary hours shall be classed as overtime and paid in accordance with clause 15.
A copy of the undertaking has been provided to the bargaining representative and I have sought its view in accordance with s.190(4) of the Act. The bargaining representative supported the undertaking.
The undertaking appears to meet the requirements of s.190(3) of the Act and I have accepted it. As a result, the undertakings are taken to be a term of the Agreement.
I am satisfied that each of the requirements of ss.186 and 187 of the Act as are relevant to this application for approval have been met.
I am satisfied that it is in the public interest to approve the Agreement.
The Agreement is approved and, in accordance with s.54 of the Act, will operate from 7 days from the date of approval of the Agreement. The nominal expiry date is 30 September 2023.
