Aboriginal Lands Parliamentary Standing Committee (Presiding Member) Amendment Act 2013

An Act to amend the Aboriginal Lands Parliamentary Standing Committee Act 2003 and to make related amendments to the Parliamentary Remuneration Act 1990.

The Parliament of South Australia enacts as follows:

Part 1Preliminary1Short title

This Act may be cited as the Aboriginal Lands Parliamentary Standing Committee (Presiding Member) Amendment Act 2013.

2Commencement

This Act will come into operation 1 month after the day on which it is assented to by the Governor.

3Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2Amendment of Aboriginal Lands Parliamentary Standing Committee Act 20034Amendment of section 3 – Interpretation
  1. (1)

    Section 3, definition of appointed member—delete the definition

  2. (2)

    Section 3, definition of the lands, (c)—delete "Pitjantjatjara Land Rights Act 1981" and substitute:

    Anangu Pitjantjatjara Yankunytjatjara Land Rights Act 1981

5Amendment of section 5 – Membership of Committee
  1. (1)

    Section 5(1)—delete "7" and substitute:

    Section 5(1)(a)—delete paragraph (a)

  3. (3)

    Section 5(2)—delete "(other than the Minister to whom administration of this Act is committed)"

  4. (4)

    Section 5(3)—delete subsection (3)

6Amendment of section 6 – Functions of Committee

Section 6(a)—delete "Pitjantjatjara Land Rights Act 1981" and substitute:

Anangu Pitjantjatjara Yankunytjatjara Land Rights Act 1981

7Amendment of section 7 – Presiding Member
  1. (1)

    Section 7(1)—delete subsection (1) and substitute:

    1. (1)

      The Committee must from time to time appoint 1 of its Legislative Council Members to be the Presiding Member of the Committee.

    2. (1a)

      The Presiding Member must preside at meetings of the Committee or, in the absence of the Presiding Member from a meeting, the members present must decide who is to preside at the meeting.

    3. (1b)

      If the members are at any time unable to come to a decision on who is to be the Presiding Member, or on who is to preside at a meeting of the Committee in the absence of the Presiding Member, the matter is referred by force of this subsection to the Legislative Council and the Legislative Council will determine the matter.

  2. (2)

    Section 7(2)—delete "The Minister, or other presiding member, has" and substitute:

    The Presiding Member or any other member presiding at a meeting of the Committee has

8Amendment of section 8 – Quorum

Section 8(2)—delete "6" and substitute:

9Amendment of section 9 – Term of office of members

Section 9(2)—delete "an appointed" and substitute:

    Section 10(1) and (2)—delete "An appointed" wherever occurring and substitute in each case:
