Act No. 32, 1990

An Act to revive section 33A of the Aboriginal Land Rights Act 1983 relating to the financial management and accountability of Aboriginal Land Councils. [Assented to 22 June 1990]

Aboriginal Land Rights (Revival of Financial Provision) 1990

The Legislature of New South Wales enacts:

Short title

1 . This Act may be cited as the Aboriginal Land Rights (Revival of Financial Provision) Act 1990.

Commencement

2. This Act commences on the date of assent.

Revival of section 33A of Aboriginal Land Rights Act 1983 No. 42

3. (1) Section 33A of the Aboriginal Land Rights Act 1983, as in force before its expiry under subsection (7) of that section, is revived as from the commencement of this Act.

(2) Section 33A (7) of the Aboriginal Land Rights Act 1983 is repealed.

Savings provision

4. Any directions given by the Minister under section 33A of the Aboriginal Land Rights Act 1983 (as inserted into that Act by the Aboriginal Land Rights (Amendment) Act 1986) that were in force immediately before 2 May 1990 are to be taken to be directions given by the Minister under that section (as revived by this Act).

Budget of N.S.W. Aboriginal Land Council for financial year commencing 1 July 1990

(1) The New South Wales Aboriginal Land Council is to be taken as having complied with section 33A (1) (as revived by this Act) in respect of the financial year commencing 1 July 1990 if it complies with this section.

(2) The Council must prepare and submit for the Minister's approval a detailed budget relating to its operations for that financial year not later than 2 weeks after the commencement of this Act.
