Aboriginal Land Rights Amendment

(Elections) Regulation 2007

under the

Aboriginal Land Rights Act 1983

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Aboriginal Land Rights Act 1983.

Explanatory note
The object of this Regulation is to amend the Aboriginal Land Rights Regulation 2002 to make it clear that optional preferential voting applies to elections for councillors of the New South Wales Aboriginal Land Council, so that an elector, after giving a first preference, may, if he or she wishes, vote for any or all of the remaining candidates in order of preference. This Regulation will apply to future elections and current elections for which nominations have been called.

This Regulation is made under the Aboriginal Land Rights Act 1983, including sections 121 (2) and 252 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Aboriginal Land Rights Amendment (Elections)
Regulation 2007.

2 Amendment of Aboriginal Land Rights Regulation 2002

The Aboriginal Land Rights Regulation 2002 is amended as set out in
Schedule 1.

Schedule 1 Amendment

(Clause 2)

Clause 55

Omit the clause. Insert instead:

55      Directions to electors

(1)  The directions to electors must include a direction that the
elector:

(a)

must record a vote on the ballot paper by placing the number “1” in the square opposite the name of the candidate for whom the elector desires to give his or her first preference vote, and

(b)

may, if he or she wishes, vote for additional candidates by placing consecutive numbers beginning with the number “2” in the squares opposite the names of those additional candidates in the order of the elector’s preferences for them.

(2)

This clause applies to any election held after the commencement of this clause, including any election for which nominations were called before the commencement of this clause.
