I, Rear Admiral PETER ROSS SINCLAIR, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 (1) of the Aboriginal Land Rights (Amendment) Act 1990 do, by this my Proclamation, appoint 16th August 1991 as the day on which the uncommenced provisions of that Act commence.

EXPLANATORY NOTE

The object of this Proclamation is to commence the uncommenced provisions of

the Aboriginal Land Rights (Amendment) Act 1990.

The uncommenced provisions are:

(a)

Schedule 1 (1) that omits section 19 of the Aboriginal Land Rights Act 1983 (“the 1983 Act”) dealing with election of members of the N.S.W. Aboriginal Land Council; and

(b)

Schedule 1 (2) that inserts a new heading to Division 1 of Part 4 of the 1983 Act dealing with the constitution and functions of the N.S.W. Aboriginal Land Council; and

(c) Schedule 1 (4) that omits sections 23–27 of the 1983 Act and inserts instead sections 23–27E dealing with the functions and des, election of councillors and staff of the N.S.W. Aboriginal Land Council; and
(d) Schedule 1 (5) that inserts Schedules 5 and 6 to the 1983 Act relating to the councillors and procedure of the N.S.W. Aboriginal Land Council; and
(e) Schedules 2–5 that mend the 1983 Act in relation to Regional and Local
Aboriginal Land Councils, disclosure of pecuniary interests,

disqualification from office and disposal of Aboriginal land; and

(f) Schedule 6 (except insofar as item (5) inserts section 33 in the 1983 Act) that deals with financial matters, investigators and administrators; and
(g) Schedule 7 (1)–(3) dealing with delegation (in place of section 55 of the 1983 Act), dissolution of Regional or Local Aboriginal Land Councils and omission of section 60 of the 1983 Act relating to staff; and
(h) Schedule 7 (5)–(7) making miscellaneous amendments to the 1983 Act relating to Aboriginal Land Councils as public authorities for certain purposes, proceedings for offences and regulations; and

(i)   Schedules 8 and 9 dealing with savings and transitional provisions and consequential amendments of other Acts.

Schedule 1 (3) of the Act, relating to the constitution of the N.S.W. Aboriginal Land Council, commenced on 17 October 1990. Schedule 6 (5), insofar as it inserted section 33 (as amended) in the 1983 Act, and Schedule 7 (4), that relates to the financial year of Aboriginal Land Councils and the preparation of annual reports, commenced on 28 June 1991.
