Aboriginal and Torres Strait Islander Commission (Meetings) Directions 2005

I, Peter McGauran, Minister for Citizenship and Multicultural Affairs, give these Directions to the Aboriginal and Torres Strait Islander Commission under subsection 12(1) of the Aboriginal and Torres Strait Islander Commission Act 1989.

1Name of Directions

These Directions are the Aboriginal and Torres Strait Islander Commission (Meetings) Directions 2005 .

2Commencement

These Directions commence when they are given to the Aboriginal and Torres Strait Islander Commission.

3Definition

In this Direction:

Commission means the Aboriginal and Torres Strait Islander Commission;

meeting has the same meaning as in the Aboriginal and Torres Strait Islander Commission Act 1989.

4Commission may hold meetings

(1)The Commission may hold a meeting of the Commission if and only if the conditions set out in sub-clauses (2) and (3) are satisfied.

(2)The Commission must not meet unless the Commission has given the Minister 30 days notice, in writing, of  its intention to do so.

(3)The Commission must give the Minister a draft agenda for the meeting at the same time that it gives written notice to the Minister in accordance with sub-clause (2).

5         Commission may resume meetings

(1)Where a meeting of the Commission has been adjourned without setting a date for its resumption, the Commission may resume the meeting if and only if the conditions set out in sub-clause (2) and (3) are satisfied.

(2)The Commission must not resume a meeting of the Commission unless the Commission gives the Minister 14 days notice, in writing, of its intention to do so.

(3)The Commission must give the Minister a draft agenda for the meeting at the same time that it gives written notice to the Minister in accordance with sub-clause (2)

(4)For the avoidance of doubt, this direction applies in respect of a meeting adjourned but not resumed at the time the direction is given.
