MR P, JONES: If the Court might consider, in relation to

the question of costs, granting a certificate to
the respondent given the nature of success by the
appellant under the Federal Proceedings {Costs)

Act.

DEANE J: Since the Court that dealt with the matter is

differently constituted to the present Court, if

you wish to apply for such a certificate you had

better put in a written submission in relation to
it. Obviously it needs to be shown to the other

side and if they want to put in anything, they can do so. I would suggest you put it in within seven

days and if the other side want to say anything,

seven days after that.
