This Determination is the A New Tax System (Goods and Services Tax) (Exempt Taxes, Fees and Charges) Determination 2001 (No. 2).

  1. Commencement

This Determination commences on gazettal.

  1. Definition

In this Determination:

Act means the A New Tax System (Goods and Services Tax) Act 1999.

  1. Australian taxes, fees or charges (Act s 81-5)

For subsection 81-5 (2) of the Act, Australian taxes, fees and charges are specified in Schedule 1.

Note   Under subsection 81-5 (1) of the Act, the payment of any Australian tax, fee or charge (other than the GST), or the discharging of a liability to make such a payment, is to be treated as the provision of consideration, to the entity to which the tax, fee or charge is payable, for a supply that the entity makes.

However, under subsection 81-5 (2) of the Act, the payment of any Australian tax, fee or charge that is specified in a written determination of the Treasurer, or the discharging of a liability to make such a payment, is not the provision of consideration.

Australian tax, fee or charge and consideration are defined in section 195-1 of the Act.

CASINO CONTROL AUTHORITY

Section 115 of the Casino Control Act 1992 requires a casino community benefit levy to be paid to the Authority in respect of each casino licence and for the Authority to pay the levy into a Casino Community Benefit Fund established in a special deposits account in the Treasury

Casino Special Employee licensing fee

Section 44 of the Casino Control Act 1992, provides that a person must not exercise in or in relation to a casino any of the functions of a special employee except in accordance with the authority conferred on the person by a licence. Staff of Star City Pty. Ltd. who are defined as special employees under section 43 and such persons directed to do so under section 47 of the Casino Control Act 1992, must be licensed by the Authority

Authority approval of Manager

The Authority is not to approve a person to manage licensed premises unless satisfied that the person is a suitable person to manage licensed premises. An application for the Authority’s approval is to be made in the form approved by the Authority accompanied by the fee required

Controlled Contracts Fees

Section 37 of the Casino Control Act 1992 prevents the Casino from entering into controlled contracts. Under regulations the Casino must pay a fixed fee of $2 000 in respect of each investigation conducted by the Authority. The fee is paid to the consolidated fund, not the Authority
