4 yearly review of modern awards – penalty rates – revised schedule.

[1] This statement deals with some scheduling issues associated with the hearing of the Penalty rates matter.

[2] This matter is listed for the hearing of the hospitality lay evidence and some expert evidence from 14–25 September 2015.

[3] A proposed revised timetable is attached.

[4] The main changes to the previous timetable are:

    (i) Tuesday 15 September: some amendments to the times at which witnesses will be required to be available (Note: Patrick Gallagher will not be scheduled in the morning session).

    (ii) Wednesday 16 September: some amendments to the times at which witnesses will be requested to be available.

    (iii) Friday 18 September: the time between 9.30 am and 11.30 am has been allocated to deal with:

    • the objections to Keith Harvey’s evidence;


    • the objections to the tender of the Productivity Commission Interim Report; and


    • objections to the expert evidence.


    (iv) Monday 21 September: the AHA witnesses who were to be called have been allocated to Tuesday 22 September.

    (v) Tuesday 22 September: timings amended and AHA witnesses previously scheduled for 21 September have been added. UV witnesses (Sangers, Petrov and Davis) have been moved to 23 September.

    (vi) Wednesday 23 September: timings amended and UV witnesses previously scheduled for 22 September have been moved to this day. Ms Pezullo will be called at 2.00 pm.

    (vii) Thursday 24 September: reserved for Ms Pezullo’s evidence.

    (vii) Friday 25 September: Professor Rose at 9.30 am and Dr Sands not before 11.45 am.

[5] Any comments on the proposed revised timetable are to be emailed to [email protected] by 4.00 pm Monday 14 September 2015.

[6] A short oral hearing will be held at 9.30 am Tuesday 15 September 2015 to settle the revised timetable.
