4 yearly review of modern awards - overtime for casuals.
Following a decision by the Group 3 Full Bench, the substantive matters of overtime entitlements for casuals in the Sporting Organisations Award 2010 and Fitness Industry Award 2010 were referred to this separately constituted Full Bench for consideration.
The issue of overtime for casuals has been identified as an outstanding item in a number of other modern awards through the award stage of the review. These modern awards will therefore be considered by this Full Bench along with the Sporting Organisations Award 2010 and Fitness Industry Award 2010.
The Fair Work Ombudsman issued a research paper in 2014 concerning the expression of rates of pay, overtime and penalty rates in modern awards. This paper included a table identifying those awards where casual employees’ entitlement to overtime and the interaction between the casual loading and overtime rates were or were not clearly stated.[1]
Subsequently, the Commission’s research area has identified awards in which there is potential ambiguity as to when casual employees’ overtime entitlements arise - for example, for hours worked outside the span of hours in the relevant award, or for hours worked in excess of 38 hours per week.
The information identified in paragraphs [3] and [4] has been compiled into a table, which is provided at Attachment A.
Interested parties are invited to provide any written response concerning the accuracy of the list of awards in Attachment A by 4.00 pm on Monday 11 December 2017. Any such response should be sent to [email protected].
Further, any interested party that seeks a variation to any of the modern awards identified in Attachment A in respect of overtime entitlements for casual employees should lodge a draft determination setting out the variation sought on or before 4.00 pm on Monday 18 December. Any such draft determination may be lodged by email at [email protected].
A Notice of Listing for a directions hearing concerning the identified modern awards will be issued subsequently.
