4 yearly review of modern awards – finalisation of exposure drafts – Aircraft Cabin Crew Award 2010.

[1] This statement addresses the outstanding issues in the review of the Aircraft Cabin Crew Award 2010 (the Cabin Crew Award).

[2] In a decision issued on 14 October 2019 1 we said that the contentious issues would be the subject of a conference convened by Commissioner Bissett.

[3] Three conferences were held in relation to amendments proposed by the Flight Attendants’ Association of Australia (FAAA) to the Exposure Draft relating to the Aircraft Cabin Crew Award 2010.

[4] On 23 December 2019, Commissioner Bissett issued a Report 2 to the Full Bench in detailing 3 substantive issues:

● Overtime for full-time and part-time regional crews;

● The appropriate divisor for determining the hourly rate of pay;

● Overtime for casuals.

[5] Each of the matters outlined in the Report have now been referred to a separately constituted Full Bench with matter number AM2020/3. The referral to the AM2020/3 Full Bench includes the matters that were previously before the Overtime for Casuals Full Bench (AM2017/51).

[6] The Full Bench in AM2020/3 will issue directions in due course.

[7] On 29 January 2020, we issued a decision 3 and exposure draft with tracked changes4 and a draft variation determination5 in relation to the Cabin Crew Award. The decision included directions for the filing of submissions by 4 pm on 4 March 2020 and submissions in reply by 4pm on 27 March 2020.

[8] Any technical and drafting issues arising from the 29 January 2020 decision, exposure draft and draft variation determination in relation to the Award (but excluding substantive matters) should be raised in accordance with the directions outlined at [7] above.

The new award came into effect from a specified date, providing clarity and certainty for all parties involved. The Commission's decision provided a comprehensive analysis of the issues, ensuring that the review process was transparent and justifiable.
