This matter concerned the review of a delegate of the Minister's decision to cancel the applicant's subclass 155 (Five Year Resident Return) visa under s 109(1) of the Migration Act 1958 (Cth). The applicant, who identified as a stateless Bidoon of the Sunni faith, had previously been granted a Protection visa based on claims of persecution in Iraq. The cancellation decision was predicated on the delegate's dissatisfaction with the applicant's identity, citing discrepancies and concerns, including the applicant providing incorrect answers regarding his citizenship status.

The primary legal issue before the Tribunal was whether the applicant had provided incorrect information in relation to his identity and citizenship status, and if so, whether this warranted the cancellation of his visa. Specifically, the Tribunal had to determine if the applicant's claims of being stateless, his family's surname changes due to religious persecution, and his subsequent experiences in Iraq were credible and supported by the evidence. The Tribunal also considered whether the applicant's Australian citizenship partner and his established community ties in Australia were relevant factors.

The Tribunal found that while there were discrepancies in the applicant's documentation and statements, it did not accept that the applicant had provided incorrect information to the Department regarding his surname. The Tribunal noted that documentary evidence provided by the applicant's sister indicated he was an Iraqi citizen. Crucially, the Tribunal determined that the decision to grant the applicant a Protection visa was not based wholly or partly on the incorrect information that formed the basis of the cancellation decision. Consequently, the Tribunal set aside the decision under review.
