JUSTICES ACT 1902—REGULATION

(Relating to the short description of offences of standing a motor vehicle in a

taxi stand or taxi zone)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Justices Act 1902, has been pleased to make the Regulation set forth hereunder.

The Justices (Short Descriptions of Motor Traffic and Other Offences) Regulation 1986 is amended by inserting in Schedule 1 after the matter relating to Regulation 83 (b) of the Motor Traffic Regulations 1935 the following matter:

EXPLANATORY NOTE

The object of this Regulation is to prescribe short descriptions of certain traffic offences for the purposes of section 145B of the Justices Act 1902. The offences involve standing a motor vehicle in an area between a pair of notices that display the words “Taxi Stand” or “Taxi Zone”.

The offences of actually standing a motor vehicle in a taxi stand or taxi zone are created by Regulations 84 (1) (b) and 129 of the Motor Traffic Regulations 1935. The offences of owning a motor vehicle that is stood in a taxi stand or taxi zone are created by Regulation 84 (1) (b) of the Motor Traffic Regulations and section 18A of the Traffic Act 1909.

This Regulation is made under the Justices Act 1902, including sections 145B (Short description of certain offences) and 154 (the general regulation-making power).
