STOCK DISEASES ACT 1923—REGULATION
(Relating to tick fever vaccinations for cattle)

[Published in Gazette No. 174 of 23 December 1994] HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Stock Diseases Act 1923 has been pleased to make the Regulation set forth hereunder.

The Stock Diseases (General) Regulation 1992 is amended:
| (a) by omitting from clause 34 (2) (b) the words “Industries, where” and by inserting instead the words “Industries in circumstances other than those referred to in paragraph (c) and where”; |
| (b) by inserting after clause 34 (2) (b) the following paragraph: |

(c)
is in the course of vaccinating stock (being stock whose export out of the State is imminent) with the tick fever vaccine where:
•
vaccination of the stock is carried out with the prior approval of an authorised officer for each animal to be vaccinated; and
•
vaccination of the stock is carried out by a registered veterinary surgeon within the meaning of the Veterinary Surgeons Act 1986; and
•
the vaccination is not carried out in a quarantine area; and
•
vaccinated stock are not permitted to enter a quarantine area; and
•
all stock to be vaccinated are, at the time of vaccination, individually identified in a manner approved by the authorised officer; and
•
all unused vaccine is destroyed by the person carrying out the vaccination by boiling or
micro wave heating. (c) by inserting after clause 34 (3) the following subclause:
(4) In this clause:
“authorised officer” means any of the following officers of
the Department of Agriculture:
(a) the Chief, Division of Animal Industries;
(b)
the Program Manager (Quality Assurance and Animal Health);
(c) the Senior Regulatory Officer;
(d) a Senior Field Veterinary Officer;
“tick fever” means either or both of the diseases
anaplasmosis and babesiosis (bovine);
‘tick fever vaccine” means a vaccine to prevent tick fever obtained from the Tick Fever Research Centre of the Department of Primary Industries of Queensland.
EXPLANATORY NOTE
The object of this Regulation is to permit the administration (with certain safeguards) of tick fever vaccine to cattle which are to be transported out of the State into areas of Australia where there are cattle tick infestations. The administration of the vaccine other than in accordance with these safeguards will constitute an offence under section 20A (wilful communication of disease) of the Stock Diseases Act 1923.
This Regulation is made under the Stock Diseases Act 1923, including section 20A.
