I, Rear Admiral PETER ROSS SINCLAIR, A.C., Governor of the State

of New South Wales, with the advice of the Executive Council, and in
pursuance of Schedule 1 to the Statute Law (Miscellaneous Provisions) Act (No. 3) 1992, do, by this my Proclamation, appoint 14 October 1994 as the day on which the amendments to the Mental Health Act 1990 set out in that Schedule commence.

EXPLANATORY NOTE

The object of th i s Proclamation is to commence the amendment to the Mental Health

Act 1990 contained in the Statute Law (Miscellaneous Provisions) Act (No. 3) 1992.

The amendments deal with the following matters:

(a) allowing certain forms and notices to be approved by the Minister rather than prescribed by regulations;

* The proclamation appointed 14.10.1994 as the date of commencement. Pursuant to s. 23 (5) of the lnterpretation Act 1987, the proclamation does not fail merely because it was not published in the Gazette until after the day appointed in the proclamation. but s. 23 ( 5 ) provides. in that event. for the Act to commence on the day on which the proclamation was published in the Gazette.

(b)

enabling the delegation of certain powers of the Chief Health Officer relating to the transfer of a mentally ill person to a hospital for treatment;

(c) the appointment of Directors and Deputy Directors of health care agencies.
