LIQUOR ACT 1982—REGULATION

(Relating to prizes payable on, and types of, approved amusement

devices in hotels)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Liquor Act 1982, has been pleased to make the Regulation set forth hereunder.

The Liquor Regulation 1983 is amended by omitting clause 63 and by

inserting instead the following clauses:

Prizes

63. (1) If a player accumulates credits to a value of $6 or more, the
hotelier, or an employee of the hotelier, is obliged, on request by the
player, to pay the player the value of those credits as a prize.
(2) The hotelier is not obliged to pay such a prize immediately but
must pay it within 48 hours after being requisted to do so by the player
entitled to the prize.

(3) If a prize is not paid immediately after a player has claimed it, the hotelier, or an employee of the hotelier, must give the player a written acknowledgment of the player’s entitlement to the prize.

(4) A prize may be paid in money or in packaged liquor. For this purpose, the market value of any liquor is the lowest price at which it

is currently sold in any part of the licensed premises.

(5) If the market value of any liquor specified by a player exceeds

the value of the player’s prize, the player must make up the difference
in value

(6) A prize paid in money may be paid in cash or by cheque.

Types of devices
63A. (1) The only types of approved amusement devices that may be used or operated on any hotel premises are ones by means of which player interactive draw poker, or some player interactive game derived from draw poker, is the only game that can be played.

(2) This clause does not prevent the use or operation of a device with features supplementary to the draw poker game, or a game derived from the draw poker game, described in this clause, if approved by the Board.

EXPLANATORY NOTE

At present, the Liquor Regulation 1983 provides that a player of an approved amusement device in a hotel who accumulates credits of not less than $6 and not more than $500 in a game (or an uninterrupted series of games) can claim a prize consisting either of money or packaged liquor. Provision is made as to the valuing, and manner of taking, of a prize in the form of liquor. No stipulation is currently made as to the types of approved amusement devices that can be used or operated

on hotel premises.

The object of this Regulation is to amend the Liquor Regulation 1983 so as:

(a) to provide that prizes to the value of credits (of not less than $6) accumulated on a device must be paid to the player within 48 hours of being claimed and that a player whose claim is not settled immediately is entitled to a written acknowledgment of his or her entitlement to the prize;

and

(b) to provide that the prize may be paid in money or in packaged liquor, and

(c) to provide that a prize paid in money may be paid in cash or by cheque;

and

(d) to provide that the only approved amusement devices that may be used or operated on hotel premises are ones by which player interactive draw poker, or a player interactive game derived from draw poker, is the only game that can be played, unless a game with supplementary features is approved by the Liquor Administration Board.

This Regulation is made under the Liquor Act 1982, including section 154 (the general regulation making power).
