HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Liens on Crops and Wool and Stock Mortgages Act 1898, has been pleased to make the Regulation set forth hereunder.

Citation

1. This Regulation may be cited as the Liens on Crops and Wool and

Stock Mortgages Regulation 1992.

Commencement

2. This Regulation commences on 27th November, 1992.

Definition

3. In this Regulation:

“the Act” means the Liens on Crops and Wool and Stock Mortgages

Act 1898.

Particulars to be included in stock mortgages

4. For the purposes of section 13 of the Act, the following particulars

are prescribed:

(a) the date of the mortgage;
(b) the full names of the mortgagor and mortgagee;

(c) the consideration or the amount of the loan;

(d)

the number and description of, and the brand or other distinctive mark on, the sheep, cattle or horses being mortgaged;

(e)

the place where the sheep, cattle or horses are being kept and the name of the principal superintendent or overseer of that place.

EXPLANATORY NOTE

The object of this Regulation is to prescribe matters of a machinery nature, being the particulars to be included in mortgages of sheep, cattle or horses for the purposes of section 13 of the Liens on Crops and Wool and Stock Mortgages Act 1898.

The particulars were formerly prescribed in a form set out in the Fourth Schedule to the Liens on Crops and Wool and Stock Mortgages Act 1898. The form is being repealed and section 13 of the Act now requires the particulars to be prescribed by regulation.
