SUBORDINATE LEGISLATION ACT 1989—REGULATION
(Relating to the exclusion of instruments from the Act)

HIS Excellency the Governor, with the advice of the Executive council, and in pursuance of the Subordinate Legislation Act 1989, has been pleased to make the Regulation set forth hereunder.

Citation
1. This Regulation may be cited as the Subordinate Legislation
Regulation 1991.
Amendment of Schedule 4 (Excluded instruments)
2. Schedule 4 to the Subordinate Legislation Act 1989 is amended by
inserting at the end of the Schedule the following matter:
19. Regulations under Part 6 of the Energy Administration Act 1987. 20. Regulations under Part 2 of the Essential Services Act 1988. 21. Regulations under the Road Obstructions (Special Provisions)
Act 1979.
22. Ordinances under Part 12A of the Local Government Act 1919,
being
(a)
planning scheme ordinances that are deemed to be deemed environmental planning instruments under the Environmental
Planning and Assessment Act 1979; and 1991—No. 578
(b)
ordinances under section 342U (2) of the Local Government Act 1919 that are continued in force by clause 11 of Schedule 3 to the Miscellanous Acts (Planning) Repal and Amendment Act 1979.

EXPLANATORY NOTE
The purpose of this Regulation is to exclude certain instruments from the
operation of the Subordinate Legislation Act 1989. The effect of this is that the
public consultation provisions of Part 2 of that Act and the staged repeal provisions
of Part 3 of that Act will no longer apply to these instruments.
