LISTENING DEVICES ACT 1984—REGULATION

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Listening Devices Act 1984, has been pleased to make the Regulation set forth hereunder.

The Listening Devices Regulation 1985 is amended by omitting from clause 3 (a) the words “section 15 (2) or 15 (4) of the Police Regulation Act 1899” and by inserting instead the words “section 99 (1) or (2) of the Police Service Act 1990”.

EXPLANATORY NOTE

The object of this Regulation is to amend the Listening Devices Regulation 1985 to replace references to certain offences (relating to bribery and corruption) under the Police Regulation Act 1899 with references to the equivalent offences under the Police Service Act 1990 which has replaced the 1899 Act.

A warrant authorising the use of a listening device for the purpose of gathering
evidence of an offence may be issued in relation to those prescribed offences.
