STOCK DISEASES ACT 1923 - REGULATION

(Relating to the feeding of pigs and orders by inspectors)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Stock Diseases Act 1923, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1 May 1990.

Amendment

2. The Stock Diseases Regulations 1936 are amended:

(a) by omitting Regulation 72D and by inserting instead the following Regulation:

Feeding of pigs

72D. (1) A person must not:
(a) feed a prohibited substance to a pig; or
(b) cause or permit a pig to feed on a prohibited substance.

(2) The owner and any person in charge of a pig must take

all steps that are reasonably practical to prevent the pig from
having access to a prohibited substance.

(3) In this Regulation, "prohibited substance" means:

(a)

the meat, bones, blood, offal or other part of the carcase of any animal or bird; or

(b) the eggs or excreta of any animal or bird; or

(c) any material or substance produced from or containing a substance specified in paragraph (a) or (b), other than a stock food or medicine registered or approved under any Act or a material or substance that is processed in a manner and at premises approved by the Chief, Division of Animal Health; or
(d) any household or commercial waste, food stuffs, garbage or any other food refuse (except bakery, fruit or vegetable waste, or refuse that has not been kept in, or is not fed to the pig from, a receptacle that contained or contains a substance specified in paragraphs (a) - (c)).

(4) A person does not commit an offence under this Regulation if that person uses a prohibited substance in a manner approved by the Chief, Division of Animal Health, for the suppression or destruction of feral pigs,

(b)

by inserting in Regulation 132 (4) after the words "route by which" the words ", or the manner in which,";

(c)

by inserting in Regulation 132 (4) after the words "by a route" the words ", or in a manner,".

EXPLANATORY NOTE

The object of this Regulation is to make the following amendments to the Stock

Diseases Regulations 1936:

(a) At present it is an offence to feed certain prohibited substances to pigs. Clause 2 (a) creates the additional offences of causing or permitting a pig to feed on, or (in the case of an owner and any person in charge of a pig) failing to take steps that are reasonably practical to prevent that pig having access to, a prohibited substance. Clause 2 (a) also provides that an offence is not committed if a person uses a prohibited substance for the suppression or destruction of feral pigs.
