(Legal Profession (Scales of Fees) Transitional Regulation 1989)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Legal Profession Act 1987, has been pleased to make the Regulation set forth hereunder.

Citation

1. This Regulation may be cited as the Legal Profession (Scales of

Fees) Transitional Regulation 1989.

Definitions

2. In this Regulation:

“Board” means the Legal Fees and Costs Board constituted under

Part 11 of the Act;

“the Act” means the Legal Profession Act 1987.

Rules fixing scales of fees etc.

3. Those provisions of:

(a)

the rules made under the Supreme Court Act 1970, the District Court Act 1973 and the Compensation Court Act 1984 which fix scales of fees and other amounts of costs in respect of proceedings referred to in section 178A; and

(b)

the rules made under the Compensation Court Act 1984 which fix scales of fees and other amounts of costs in respect of proceedings referred to in 180 of the Act,

continue to have effect until a relevant determination by the Board

under those sections comes into force.

EXPLANATORY NOTE

As a consequence of the Legal Profession (Amendment) Act 1989, the Legal Fees and Costs Board will make determinations fixing the fees and costs payable to barristers in respect of proceedings before the Supreme Court, the District Court and the Compensation Court and fees and costs payable to solicitors in respect of proceedings before the Compensation Court. The object of this Regulation is to enable existing rules under the Supreme Court Act 1970, the District Court Act 1973 and the Compensation Court Act 1984 (concerning scales of fees and costs paid to barristers and solicitors in proceedings before those courts) to continue in force until the Board makes determinations in respect of those matters.
