However, the court determined that the applicant's fear arising from his brother's position and the Taliban's interest warranted further consideration.

Consequently, the court remitted the decision to the Administrative Appeals Tribunal for redetermination, with directions to reconsider the claim concerning the brother's position and the associated fear of harm.
