Overview

The Woomera Prohibited Area Rule 2014 was enacted to establish and manage the Woomera Prohibited Area, a significant defense area in South Australia, thereby ensuring the safety and security of military operations and the public. This legislative instrument, known as the Woomera Prohibited Area Rule 2014 Determination of Exclusion Periods for the Green Zone for 1 September 2019 – 5 October 2019, was introduced under subsection 8(1) of the Woomera Prohibited Area Rule 2014 by the Director of the Woomera Prohibited Area Coordination Office, as a delegate of the Minister for Defence. The primary policy objective is to delineate specific periods during which certain zones within the Woomera Prohibited Area are off-limits to the public, ensuring that these areas can be used for military training and operations without interference. This legislative instrument outlines exclusion periods for various parts of the Green Zone, aiming to balance public access with the imperatives of national defense.

Scope and Application

The Woomera Prohibited Area Rule 2014 Determination of Exclusion Periods for the Green Zone for 1 September 2019 – 5 October 2019 applies to specific parts of the Woomera Prohibited Area, which is designated under the Woomera Prohibited Area Rule 2014. This legislative instrument identifies certain exclusion periods during which certain activities are prohibited in defined sections of the Green Zone within the Woomera Prohibited Area. The exclusion periods are determined by the Director of the Woomera Prohibited Area Coordination Office, as a delegate of the Minister for Defence, in accordance with the provisions of the Woomera Prohibited Area Rule 2014. The instrument specifies geographic coordinates and boundaries that define the areas of the Green Zone to which these exclusion periods apply. There are no exclusions, exemptions, or thresholds explicitly stated in this particular legislative instrument; however, the broader Woomera Prohibited Area Rule 2014 may contain such provisions. The legislation operates within the Commonwealth jurisdiction and its application is further defined and potentially extended or restricted through subordinate instruments as may be necessary.

Key Provisions

The main operative sections of the Woomera Prohibited Area Rule 2014 Determination of Exclusion Periods for the Green Zone for 1 September 2019 – 5 October 2019 (the Determination) establish specific exclusion periods for certain parts of the Woomera Prohibited Area, which is designated as the Green Zone. These exclusion periods are detailed in Parts 1, 4, and 7 of the Schedule. The Determination specifies that during these periods, certain activities within the defined areas of the Green Zone are restricted or prohibited. The exclusion periods for the Green Zone are from 12 September 2019 to 18 September 2019, 19 September 2019 to 25 September 2019, 26 September 2019 to 2 October 2019, 3 October 2019 to 5 October 2019, 8 September 2019 to 14 September 2019, 10 September 2019 to 16 September 2019, 17 September 2019 to 23 September 2019, and 24 September 2019 to 30 September 2019, and 1 October 2019 to 5 October 2019. The Determination imposes obligations on any person who enters or intends to enter the Woomera Prohibited Area during the specified exclusion periods. It requires compliance with the restrictions and prohibitions in place during these times. The obligations include refraining from activities that are not explicitly permitted under the Determination. For example, individuals and entities must ensure that no unauthorised activities, such as unauthorised entry, movement, or operation of vehicles, take place within the defined Green Zone areas during the exclusion periods. This necessitates adherence to the spatial and temporal constraints set out in the Schedule. Breach of the provisions outlined in the Determination may result in civil or criminal consequences. Specifically, unauthorised entry into the Woomera Prohibited Area or the Green Zone during the exclusion periods may be subject to penalties. While the exact penalties are not detailed in the Determination, it is implied that such breaches could lead to enforcement actions under the primary legislation, the Woomera Prohibited Area Rule 2014. Typically, penalties for breaches of the Woomera Prohibited Area Rule 2014 can include fines and, in more severe cases, imprisonment. The specific penalties would depend on the nature and severity of the breach, as well as any additional provisions or regulations applicable under the overarching Act.
