Overview

The Woomera Prohibited Area Rule 2014 Determination of Exclusion Periods for Amber Zone 1 and Amber Zone 2 for Financial Year 2016-2017 was enacted to establish specific exclusion periods for Amber Zone 1 and Amber Zone 2 within the Woomera Prohibited Area during the financial year 2016-2017. This legislative instrument was made under subsection 8(1) of the Woomera Prohibited Area Rule 2014, with the aim of managing and regulating access to these areas, which are critical for national security and defence purposes. The instrument was registered on 30 March 2016 and came into effect on 31 March 2016. It has since been amended on multiple occasions, with the latest amendment registered on 21 December 2016 and coming into effect on 22 December 2016. The policy objective is to ensure that the exclusion periods are effectively managed to facilitate necessary activities within the Woomera Prohibited Area while maintaining stringent security measures.

Scope and Application

The Woomera Prohibited Area Rule 2014 Determination of Exclusion Periods for Amber Zone 1 and Amber Zone 2 for Financial Year 2016 - 2017 sets out specific periods during which certain activities are prohibited in Amber Zone 1 and Amber Zone 2 within the Woomera Prohibited Area. This legislative instrument applies to any person or entity that may need to access or operate within these designated areas during the specified exclusion periods. The Woomera Prohibited Area is a Commonwealth-controlled area, thus the legislation has a national reach within Australia. The exclusion periods are determined under subsection 8(1) of the Woomera Prohibited Area Rule 2014 and are detailed in the attached Schedule, which lists the specific dates when access to these zones is not permitted for the financial year 2016-2017. Any amendments to the exclusion periods are made through subordinate instruments, as indicated in the legislation history and amendment history endnotes. It is important to note that the effect of uncommenced amendments is not reflected in the text of the compiled law, and further details can be found on the Legislation Register.

Key Provisions

The Woomera Prohibited Area Rule 2014 Determination of Exclusion Periods for Amber Zone 1 and Amber Zone 2 for Financial Year 2016 - 2017 sets out the specific exclusion periods for Amber Zone 1 and Amber Zone 2 within the Woomera Prohibited Area for the financial year 2016-2017. These periods are detailed in the Schedule of the legislation (section 1). The exclusion periods for Amber Zone 1 are 14 May to 20 May, 21 May to 27 May, 28 May to 3 June, 4 June to 10 June, 11 June to 17 June, 18 June to 24 June, and 25 June to 30 June 2017. For Amber Zone 2, the exclusion periods are 11 June to 17 June, 18 June to 24 June, and 25 June to 30 June 2017. The Woomera Prohibited Area and its zones are prescribed under section 6 of the Woomera Prohibited Area Rule 2014. The Act imposes obligations on the parties or entities operating within the Woomera Prohibited Area to adhere to the specified exclusion periods for Amber Zones 1 and 2. This includes ensuring that activities within these zones are halted during the designated periods to comply with the rules set forth in the legislation. Failure to comply with these exclusion periods could result in legal consequences, as the Act aims to regulate and control activities within these sensitive areas. Breach of the exclusion periods specified in the Woomera Prohibited Area Rule 2014 Determination of Exclusion Periods for Amber Zone 1 and Amber Zone 2 for Financial Year 2016 - 2017 can lead to civil or criminal penalties. The specific penalties for non-compliance are not detailed within the text provided, but generally, violations of such regulations could result in fines, imprisonment, or other legal sanctions as prescribed by the broader legislative framework governing the Woomera Prohibited Area. It is essential for entities and individuals to strictly adhere to the exclusion periods to avoid any legal repercussions.
