Overview

The Wireless Telegraphy Regulations, enacted as Statutory Rules 1940 No. 181 under the Wireless Telegraphy Act 1905-1936, address the need to amend existing regulations pertaining to licence fees for wireless telegraphy. These regulations were introduced by the Commonwealth of Australia, specifically by the Governor-General in Council, and aim to reflect adjustments in the economic conditions of the time. The policy objective is to ensure that the regulatory framework remains relevant and practical in its application, thereby supporting the effective administration of wireless telegraphy within the country. The changes, which took effect from 1 September 1940, involved modifying the figures specified in Regulation 77 of the Wireless Telegraphy Regulations, reflecting a slight reduction in the stipulated fees.

Scope and Application

The Wireless Telegraphy Regulations, as amended by these Statutory Rules, apply to all individuals and entities engaging in wireless telegraphy within the Commonwealth of Australia. This includes the operation and maintenance of wireless telegraphy apparatus, the licensing of such apparatus, and the associated fees. The Regulations are an extension of the Wireless Telegraphy Act 1905-1936 and cover all aspects of wireless telegraphy operations across the Commonwealth. The specified amendments to the licence fees are effective from the first day of September 1940, adjusting the fees as per the regulation. These amendments are made under the authority of the Governor-General, in accordance with the Federal Executive Council’s advice. The Regulations also allow for further modifications through subordinate instruments, ensuring flexibility in administration and enforcement.

Key Provisions

The Wireless Telegraphy Regulations 1940, made under the Wireless Telegraphy Act 1905-1936, amend the existing regulations to modify the licence fees for wireless telegraphy services. Regulation 77 of the Wireless Telegraphy Regulations is specifically altered, as detailed in the statutory rules. The amendment reduces the licence fees from £21 to £20 for one class of licence and from £15 to £14 for another class, as specified in sub-regulation (1) of Regulation 77 (paragraphs (a) and (b)). These amendments are designed to adjust the financial obligations associated with wireless telegraphy licences, potentially reflecting changes in economic conditions or the operational costs of providing these services. The obligations imposed by these regulations are primarily concerned with ensuring that licensees comply with the updated fee structures. Licence holders must now pay the revised amounts specified in the amended Regulation 77, which may involve administrative updates to their billing and payment processes. The requirement to adhere to these new fees is crucial for maintaining the financial integrity of the regulatory framework governing wireless telegraphy services in Australia. Ensuring compliance with these fee changes is essential for the continued operation of licensed wireless telegraphy services under the Act. Breaches of these regulations, if any, could potentially lead to enforcement actions. While the specific penalties are not detailed in the provided excerpt, under the Wireless Telegraphy Act 1905-1936, non-compliance with regulatory requirements could result in penalties, which may include fines or other sanctions. The Act provides for the imposition of penalties for various infractions, including operating without a valid licence or failing to adhere to specified regulations. The maximum penalties for such breaches can be substantial, reflecting the importance of compliance with wireless telegraphy regulations to ensure the proper functioning of communication services.
