Overview

The Wire Netting Bounty Regulations 1939 were enacted under the Wire Netting Bounty Act 1939 by the Governor-General, acting on the advice of the Federal Executive Council. This legislative instrument was introduced to provide detailed administrative provisions for the implementation of the bounty scheme established by the Act, which aimed to incentivise the manufacturing of wire netting in Australia. The Regulations outline procedures for the appointment of authorized agents, the submission of notices of intent to claim bounty, the format for bounty applications, and the conditions under which the bounty can be claimed. The policy objective is to facilitate the administration of the bounty scheme efficiently while ensuring compliance with the legislative requirements.

Scope and Application

The Wire Netting Bounty Regulations, made under the Wire Netting Bounty Act 1939, apply to manufacturers who intend to claim a bounty for wire netting produced for sale and use within the Commonwealth of Australia. These regulations govern the procedures for appointing authorized agents to handle documentation, notifying the Collector of Customs of the intention to claim a bounty, and submitting an application for the bounty. The regulations specify the timing of these notifications and applications, as well as the conditions under which wire netting must be manufactured. The regulations also provide for the forms that must be completed and submitted, which include the appointment of authorized agents, the notice of intention to claim bounty, and the actual application for bounty. These forms are detailed in the Schedule to the Regulations. The regulations apply across the Commonwealth, ensuring that manufacturers nationwide are aware of and comply with the requirements to claim the bounty. Any exclusions or exemptions from the bounty scheme are not specified in these regulations, which means that all eligible manufacturers must adhere to the outlined processes.

Key Provisions

The Wire Netting Bounty Regulations 1939, made under the Wire Netting Bounty Act 1939, primarily outline the processes and conditions for claiming a bounty on wire netting manufactured in Australia. Key sections include the authority for manufacturers to appoint authorized agents (Reg. 4), the requirement for manufacturers to notify their intention to claim bounty (Reg. 5), and the procedures for submitting a bounty application (Reg. 6). These regulations also detail the forms to be used for appointment, notification, and application (Schedule, Forms 1, 2, and 3). Manufacturers are obligated to ensure that the wire netting materials are stored separately in their factory (Reg. 8). Additionally, they must notify the Collector of their intention to claim a bounty within specified timeframes (Reg. 5) and submit a formal application supported by a statutory declaration within thirty days of completing production, or within sixty days for quarterly periods (Reg. 7). Authorized agents may execute these notices and applications on behalf of the manufacturer (Reg. 4). Failure to comply with these regulations can result in legal consequences. Specifically, making a false statement in a statutory declaration is an indictable offence, punishable by imprisonment for up to four years (Schedule, Form 3). The regulations impose a structured process to ensure that manufacturers meet the requirements for claiming the bounty while maintaining the integrity of the application process.
