Overview

The Wine Overseas Marketing Act 1929-1945 was enacted to regulate the marketing of Australian wine overseas, providing a framework for the export and promotion of Australian wine internationally. The Act aimed to ensure that the wine industry was managed efficiently and that Australian wine could compete effectively in global markets. These regulations, introduced by the Governor-General in Council under the authority of the Act, provide specific details on the administration and operational aspects of the Wine Overseas Marketing Board, including amendments to staff salaries, allowances, and other related matters. The policy objective is to streamline the operations of the Board, ensuring that its staff are adequately compensated and that the Board can function effectively in its role of promoting Australian wine overseas.

Scope and Application

The Wine Overseas Marketing (Staff) Regulations, made under the Wine Overseas Marketing Act 1929-1945, apply to officers employed by the Wine Overseas Marketing Board. These officers include various roles such as the Secretary to the Board, the Overseas Representative, and clerical and typist positions. The Regulations govern the remuneration, conditions of service, and allowances for these officers, establishing specific salary scales, increments, and allowances for duties such as overtime, travel, and meals. The application of these Regulations is nationwide, as they pertain to the Commonwealth-level Wine Overseas Marketing Board. There are no explicit exclusions or exemptions mentioned within the scope of these Regulations, which focus on the administrative and operational staff of the Board. The Regulations may be further extended or restricted through subordinate instruments, though no such amendments are specified in this particular legislative instrument.

Key Provisions

The Statutory Rules 1950, No. 28, made under the Wine Overseas Marketing Act 1929-1945, primarily amend the Wine Overseas Marketing (Staff) Regulations, specifically concerning the salaries of officers, adjustments for cost of living, duty on holidays, overtime, meal allowances, travelling allowances, and entertainment expenses. Regulation 4(2) allows the Board to grant annual salary increments to officers based on their conduct, diligence, and efficiency, ensuring their annual salary does not exceed the specified maximum. Regulation 4a modifies the adjustment of salaries to account for variations in the cost of living, adjusting the index figures and amounts for different age groups. Regulation 6a revises the duty on holidays for male and female officers, while Regulation 7 adjusts the overtime pay rates for male and female officers. Regulation 8 introduces meal allowances for officers required to work outside their usual hours, with rates based on their annual salary. Regulation 12 replaces the previous travelling allowance regulations, providing new rates and conditions for officers required to travel or reside temporarily for Board business. Regulation 12a details the fare allowances for officers travelling for Board business, including provisions for officers taking up permanent duty overseas. Regulation 13a allows officers to claim entertainment expenses, subject to approval and limits, while Regulation 13b permits the Minister to determine rent and living allowances for the Overseas Representative and Assistant Overseas Representative. These regulations impose obligations on the Board and officers to manage and report on salaries, allowances, and expenses accurately and within the specified limits. Failure to comply with these regulations may result in financial discrepancies, misallocation of resources, or administrative penalties. The specific penalties for non-compliance are not detailed in the text, but breaches could lead to disciplinary actions, financial penalties, or other corrective measures as determined by the Board.
