Overview

The Wheat Marketing Act 1979 was enacted to provide for the marketing of wheat in Australia and to establish the Australian Wheat Board (AWB). The Act aimed to address the need for a national body to manage the marketing of wheat, ensuring that the industry operated in a coordinated and efficient manner. The Wheat Marketing Act 1979 was enacted by the Australian Parliament and its policy objective was to create a stable and efficient wheat marketing system that would benefit both producers and consumers. The Act established the AWB as the sole marketing authority for wheat in Australia, giving it the power to buy, sell, and export wheat on behalf of the wheat industry. The accompanying Statutory Rules 1980 No. 237, made under the Wheat Marketing Act 1979, further regulated the operations of the AWB and the wheat marketing industry, including the election of board members and the enrolment of wheat growers. These Regulations aimed to ensure that the AWB operated in a transparent and democratic manner, with the interests of the wheat growers at the forefront.

Scope and Application

The Statutory Rules 1980 No. 237, enacted under the Wheat Marketing Act 1979, primarily focus on the amendment of the Wheat Industry Stabilization (Election of Board) Regulations. These regulations govern the electoral process for selecting members of the Wheat Industry Stabilization Board, which is responsible for overseeing the wheat industry. The amendments apply to wheat growers and companies involved in wheat production, ensuring that individuals and entities eligible to vote in the elections meet specific criteria, such as being at least 18 years old. The regulations also clarify the process for including names in the rolls of wheat growers, the appointment of company representatives, and the administration of voting procedures. Geographic and jurisdictional reach of these regulations is nationwide, as they pertain to the national wheat industry. Any exclusions or exemptions are not explicitly stated, but the regulations do provide detailed processes and criteria for enrolment and voting, which implicitly determine who is included or excluded. Subordinate instruments may further extend or restrict the application of these regulations, though specific details are not provided in the text.

Key Provisions

The main operative sections of these regulations involve several amendments to the Wheat Industry Stabilization (Election of Board) Regulations, continuing in force under the Wheat Marketing Act 1979. Regulation 2 is repealed, while Regulation 3's definition of "voter" is updated. Regulation 6, concerning the preparation of rolls, is also amended, requiring that individuals and companies submit claims for enrolment with the Deputy Returning Officer for a state. Regulation 7 outlines the process for companies to appoint a representative for voting purposes, ensuring the appointed individual is a wheat grower and meets the age requirement. Regulation 8A, concerning persons entitled to vote at an election, is updated to include the age requirement. Further amendments include changes to voting papers, forms of declaration, scrutiny of votes, and offences in connection with polling. The regulations impose several obligations on parties involved in the wheat industry. Individuals and companies must submit duly completed claims for enrolment to the Deputy Returning Officer if their names are not included in the rolls of wheat growers for a state. Companies are required to appoint a representative who is a wheat grower and meets the age requirement. Additionally, all persons entitled to vote must ensure they are included on the roll of wheat growers and must be at least 18 years of age on the election date. Voting papers and declarations must be completed accurately and submitted in a timely manner. The Deputy Returning Officer is obligated to notify companies if their appointed representative's name is not noted on the roll and to scrutinise votes and declarations according to the regulations. Violations of these regulations can lead to various offences and penalties. Regulation 48 outlines offences related to polling, including voting without being entitled to do so. The penalties for these offences are not explicitly stated in the regulations but can be inferred from other sections, such as Regulation 44, which mentions a penalty of $100. Other penalties may be applicable under the Wheat Marketing Act 1979 or other relevant legislation. Companies and individuals must adhere to the regulations to avoid any potential civil or criminal consequences, which may include fines or other sanctions.
