Overview

The Western Australia Grant Act 1933 was enacted to provide financial assistance to the State of Western Australia, addressing the economic difficulties faced during the Great Depression. The Act was assented to on 15th December 1933, and it was passed by the King's Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia. The primary objective of this legislation was to allocate a sum of Six hundred thousand pounds from the Consolidated Revenue Fund to be paid as financial assistance to Western Australia over the fiscal year starting on the first day of July 1933. The payments were to be made in equal monthly instalments directly from the Consolidated Revenue Fund, ensuring that the financial aid reached the state in a structured and timely manner.

Scope and Application

The Western Australia Grant Act 1933 is a Commonwealth Act that authorises the allocation of a specific sum from the Consolidated Revenue Fund to provide financial assistance to the State of Western Australia. This Act applies to the State of Western Australia and pertains to the financial support provided to it by the Commonwealth Government. The sum of Six hundred thousand pounds is to be paid in equal monthly instalments, and these payments will be appropriated from the Consolidated Revenue Fund, as specified in the Act. The application of the Act is limited to the financial assistance granted to Western Australia for the year commencing on the first day of July 1933, as outlined in the legislation. There are no stated exclusions, exemptions, or thresholds within the Act itself, but the application and conditions of the grant may be further detailed in subordinate instruments or related legislation.

Key Provisions

The Western Australia Grant Act 1933 (Act) provides for the payment of a specific financial assistance amount to the State of Western Australia. Section 2 establishes that a sum of Six hundred thousand pounds (approximately AUD 1.2 million in 2023 terms) is to be paid during the financial year beginning on the first day of July 1933. Section 3 outlines that this amount is to be paid in equal monthly instalments, ensuring a steady flow of funds to the State over the designated period. Section 4 confirms that these payments will be made from the Consolidated Revenue Fund, which is specifically appropriated for this purpose under the Act. The Act imposes clear obligations on the Commonwealth Government, primarily to disburse the specified sum to Western Australia in the manner prescribed. The Commonwealth must ensure that payments are made in equal monthly instalments as stipulated in Section 3. This requires meticulous planning and adherence to the fiscal calendar to maintain the integrity of the financial assistance program. Furthermore, by appropriating the Consolidated Revenue Fund as mentioned in Section 4, the Commonwealth is obligated to ensure that these funds are set aside and properly allocated for the purpose of providing financial assistance to Western Australia. Failure to comply with the provisions of the Act can result in legal repercussions. While the Act does not explicitly enumerate offences or penalties, breaches of statutory obligations could lead to legal action under common law principles of contract and administrative law. Additionally, non-compliance might result in political and financial ramifications, as the intended purpose of the grant is to provide essential financial support to Western Australia. The absence of explicit penalties in the Act suggests that the focus is more on the obligation to fulfil the grant rather than punitive measures for non-compliance.
