Overview

The Statutory Rules 1966 No. 66, enacted under the Weights and Measures (National Standards) Act 1960-1964, was introduced to address the need for a streamlined process in approving modifications to patterns of instruments intended for trade, particularly those already approved by state authorities. This legislative instrument was made by the Governor-General in and over the Commonwealth of Australia, acting on the advice of the Federal Executive Council, with the aim of enhancing the efficiency and consistency of the national standards for trade-related instruments. The policy objective of these regulations is to allow the Commission to approve modifications of state-approved instrument patterns without the need for a full examination, provided the modifications do not affect the parts already approved by the state authority. This amendment aims to facilitate smoother interstate trade by reducing bureaucratic hurdles and ensuring that modifications maintain the required standards.

Scope and Application

The Weights and Measures (National Standards) Act 1960-1964, as amended by the Statutory Rules 1966 No. 66, applies to the regulation of weights and measures used in trade and commerce across Australia. This Act mandates the maintenance and use of national standards for weights and measures to ensure uniformity and fairness in commercial transactions. The regulation particularly focuses on the approval of patterns of instruments used in trade, allowing the Commonwealth to grant modifications to patterns previously approved by state authorities, thereby facilitating trade without the need for extensive re-examination of unchanged aspects of the patterns. The geographic reach of this Act is national, impacting all states and territories within Australia, as it seeks to harmonise standards across different jurisdictions. Any entity or person involved in the trade of goods that require measurement, such as businesses and retailers, falls under the purview of this Act. The Act’s application extends to modifications of approved patterns, provided these modifications are for the purpose of facilitating trade and do not compromise the integrity of the measurements. There are no explicit exclusions or exemptions stated in the provided text, although the discretion of the Commission to grant approvals suggests a focus on practical considerations in trade.

Key Provisions

The main operative sections of the Statutory Rules 1966 No. 66, which are amendments to the Weights and Measures (Patterns of Instruments) Regulations under the Weights and Measures (National Standards) Act 1960-1964, introduce a specific provision regarding the approval of modifications to approved patterns of instruments. Section 12 of the amended regulations allows the Commission to approve modifications to patterns of instruments for trade without the need for an examination of the modified parts that already have State approval. This is to streamline the process for businesses seeking to use modified instruments in trade within the respective states, provided the modifications do not alter the instrument's compliance with national standards. The Act imposes obligations on the parties involved in the modification and use of instruments for trade. Manufacturers or entities wishing to modify an approved instrument pattern must submit an application to the Commission for approval of the modification. The Commission, in turn, has the discretion to approve the modified pattern based on the existing State approval, ensuring that the modified instrument remains suitable for trade use within that state. This process ensures that modifications are assessed and approved in a manner that maintains the integrity and accuracy of measurements used in trade. Failure to comply with the provisions of the Weights and Measures (National Standards) Act 1960-1964 can result in both civil and criminal penalties. Under the Act, using an unapproved instrument for trade can lead to fines or other penalties as stipulated by the relevant legislation. The specific penalties for breaches are not detailed in the Statutory Rules but would be governed by the overarching Act and any associated regulations or guidelines. The seriousness of the offence and the potential penalties would depend on factors such as the extent of non-compliance and any harm caused by the use of unapproved instruments.
