Overview

The Water Amendment (Indigenous Authority Member) Act 2019 was enacted by the Parliament of Australia to address a perceived gap in the representation of Indigenous perspectives within the Murray-Darling Basin Authority. This Act amends the Water Act 2007 to ensure that Indigenous voices are adequately represented in the decision-making processes concerning the management of the Basin’s water resources. The overarching policy objective of this amendment is to integrate Indigenous knowledge and expertise into the governance structure of the Murray-Darling Basin Authority, thereby promoting more culturally sensitive and effective water management practices. This legislative change came into effect on 3 October 2019, the day after receiving Royal Assent.

Scope and Application

The Water Amendment (Indigenous Authority Member) Act 2019 is a piece of Australian legislation that amends the Water Act 2007 to incorporate an Indigenous member within the Murray-Darling Basin Authority. The Act applies to individuals being considered for appointment as the standing Indigenous Authority member within the Authority, as well as the Authority itself and relevant interest groups. It specifies eligibility criteria for the standing Indigenous Authority member, requiring that the individual be an Indigenous person with a high level of expertise in Indigenous matters relevant to Basin water resources and not a member of the governing body of a relevant interest group. The Act's jurisdiction spans the Commonwealth of Australia, impacting the governance and operations of the Murray-Darling Basin Authority, which is a federal body responsible for managing water resources in the Murray-Darling Basin. The Act commenced on 3 October 2019, the day after receiving Royal Assent. While the Act primarily amends the Water Act 2007, it does not specify exclusions, exemptions, or thresholds within its provisions. The Act’s application may be further defined or extended through subordinate instruments issued under its authority.

Key Provisions

The Water Amendment (Indigenous Authority Member) Act 2019 (C2019A00080) amends the Water Act 2007 to introduce a new standing Indigenous Authority member within the Murray-Darling Basin Authority. Section 177(b) of the Water Act 2007 is repealed and replaced with a new subparagraph (b) that introduces the standing Indigenous Authority member. This member is an Indigenous person and is distinct from the four other members of the Authority. The eligibility criteria for this role are specified in subsection 178(2A), which stipulates that the individual must possess a high level of expertise in Indigenous matters relevant to Basin water resources and must not be a member of the governing body of a relevant interest group. Additionally, the term "Indigenous person" is defined in subsection 4(1) of the Water Act 2007. The Act also amends subsection 178(2) to clarify that the standing Indigenous Authority member is excluded from certain responsibilities, and subsection 180(3) is modified to include the standing Indigenous Authority member in the list of individuals who cannot act as the Authority Chair. The Water Amendment (Indigenous Authority Member) Act 2019 imposes several obligations on the parties it governs. Primarily, it mandates that the standing Indigenous Authority member must be an Indigenous person with significant expertise in Indigenous matters relevant to Basin water resources. Moreover, the individual cannot be a member of the governing body of a relevant interest group. This ensures a level of independence and impartiality in the role. The Act also places certain limitations on the standing Indigenous Authority member's responsibilities, explicitly excluding them from acting as the Authority Chair, as stipulated in subsection 180(3). These obligations are designed to maintain the integrity and effectiveness of the Murray-Darling Basin Authority's operations. Under the Water Amendment (Indigenous Authority Member) Act 2019, there are no specific offences outlined, but breaches of the eligibility criteria for the standing Indigenous Authority member could have significant consequences. The primary risk lies in the potential for legal challenges or administrative actions if the appointment process does not adhere to the prescribed criteria. While the Act does not specify penalties, any failure to comply with the eligibility requirements could result in the appointment being declared invalid, leading to potential disruptions in the Authority's functioning. Additionally, the individual's failure to meet the criteria could result in their removal from the position, with further implications for the Authority's operations and decision-making processes.
