I, IAN GORDON CAMPBELL, Minister for Local Government, Territories and Roads, make the following Regulations under the Water Agencies (Powers) Act 1984 (WA) (CKI).

1 Name of Regulations

  These Regulations are the Water Agencies (Infringements) Regulations 1994 (WA) (CKI) Amendment Regulations 2004 (No. 1).

2 Commencement

  These Regulations commence on the date of their notification in the Gazette.

3 Amendment of Water Agencies (Infringements) Regulations 1994 (WA) (CKI)

  Schedule 1 amends the Water Agencies (Infringements) Regulations 1994 (WA) (CKI).

substitute

5 Authorised, designated and prescribed persons (Act s 103)

  For section 103 of the Act:

authorised person means a person who is authorised, by a prescribed person, to give an infringement notice in respect of an alleged offence under by-law 2 (1) of the Water Agencies (Water Restrictions) By-laws 1998 (WA) (CKI).

designated person means the person holding, or acting in, the office known as Facilities Manager, Water Corporation, Cocos (Keeling) Islands.

prescribed person means:

 (a) the person performing the duties of Assistant Secretary, Territories Branch of the Department of Transport and Regional Services; or

 (b) the Administrator, within the meaning given in the Administration Ordinance 1975.
