Overview

The Statutory Rules 1941, No. 264, made under the War Service Homes Act 1918-1941, were enacted to address administrative needs in the management of war service homes, particularly in relation to staff remuneration and allowances. The War Service Homes Act was initially introduced to provide for the establishment and management of homes for returned service personnel, but over time, it became necessary to update the regulations governing staff salaries and allowances to reflect changes in economic conditions and the cost of living. Enacted by the Governor-General in Council, these regulations aimed to ensure fair compensation and appropriate allowances for the staff managing these homes. The policy objective behind these amendments was to maintain the operational efficiency of war service homes by providing adequate remuneration and benefits to the staff, thereby ensuring the effective care and support of returned service personnel.

Scope and Application

The War Service Homes (Staff) Regulations, as amended by Statutory Rules 1941, No. 264, pertain specifically to staff within the War Service Homes framework, governing aspects such as salary, overtime, Sunday duty, compensation, allowances, and fares. These regulations apply to all Commonwealth employees within the scope of the War Service Homes Act 1918-1941, ensuring that the staff's remuneration and working conditions are regulated in accordance with the statutory framework. The amendments outlined in these regulations affect the calculation of salary-related benefits and allowances, impacting the financial entitlements of the affected staff members. The regulations apply across the Commonwealth of Australia, as they are promulgated under the authority of the Governor-General, and they take effect from the date specified in the legislative instrument, which is the eighteenth day of September, 1941. The regulations do not explicitly state any exclusions, exemptions, or thresholds, and their application is limited to the adjustments specified in the document. The regulations may be further extended or restricted through subsequent subordinate instruments.

Key Provisions

These Regulations, made under the War Service Homes Act 1918-1941, primarily focus on amending existing staff regulations concerning remuneration and allowances for staff within war service homes. The key amendments include changes to the salary figures used to determine the removal of furniture, recording and payment of overtime, Sunday duty compensation, holiday duty compensation for salaries exceeding £450 per annum, travelling allowances, fares, meal allowances, and excess travelling time. For instance, Regulation 30 has had its salary figures increased by £12, while Regulation 44, 45, 48, 75, 86, 89, and 90 have had specific salary figures updated from £450 to £462, and from £336 to £348 in the case of Regulation 86. The Regulations impose several obligations on the parties they govern, particularly the staff within war service homes. Staff must now adhere to the updated salary figures when claiming for removal of furniture, overtime, Sunday duty, holiday duty, travelling allowances, fares, meal allowances, and excess travelling time. These changes ensure that the compensation and allowances provided are reflective of the updated salary figures, thereby maintaining fairness and consistency within the remuneration structure. Under these Regulations, there are no explicit provisions detailing offences, penalties, or civil or criminal consequences for breach. However, it is implied that failure to comply with the updated salary figures and associated regulations could result in disputes over compensation and allowances. Such disputes may require resolution through administrative or legal processes as outlined under the broader War Service Homes Act 1918-1941 or other relevant legislation. There are no maximum penalties stated within these Regulations themselves, but any breaches of the Act could lead to fines or other legal repercussions depending on the severity and nature of the breach.
