Overview

The War Pensions Appropriation Act 1944 was enacted by the Commonwealth Parliament to address the immediate financial need for war pensions for veterans returning from World War II. Assented to on 6th October 1944, the Act authorises the appropriation of £12,000,000 from the Consolidated Revenue Fund for the War Pensions Fund established under the Audit Act 1901-1934. The primary policy objective of this Act is to ensure that the necessary financial resources are available to support the provision of war pensions to those who have served and are in need of such support due to their service. This appropriation is crucial in recognising the sacrifices made by these individuals and providing them with the care and financial assistance they require.

Scope and Application

The War Pensions Appropriation Act 1944 applies to the allocation of funds specifically designated for war pensions within the Commonwealth of Australia. The Act appropriates £12,000,000 out of the Consolidated Revenue Fund to be directed towards the War Pensions Fund established under the Audit Act 1901-1934. This allocation is intended to support the provision of war pensions to eligible recipients, ensuring that those who have served and subsequently require financial assistance due to disabilities or other circumstances related to their service are provided for. The Act applies to the Commonwealth level, impacting federal financial obligations and the management of war pensions across Australia. The Act does not explicitly outline exclusions or exemptions, but its primary purpose is to ensure the necessary funds are available for those who have served and are in need of pension support. The application and interpretation of the Act may be extended or detailed through subordinate instruments, which could provide further guidance on the specific administration and distribution of the appropriated funds.

Key Provisions

The War Pensions Appropriation Act 1944 (section 1) provides the legislative framework for allocating a significant sum for war pensions. Section 3 of the Act specifies that £12,000,000 is to be appropriated from the Consolidated Revenue Fund for the War Pensions Fund, which is established under the Audit Act 1901-1934. This appropriation is intended to support the payment of war pensions to eligible recipients. The Act imposes specific obligations on the government regarding the allocation and management of the funds appropriated. Section 3 ensures that the designated amount is directed towards the War Pensions Fund, which is a trust account managed under the Audit Act 1901-1934. This fund is specifically designated for the purpose of disbursing war pensions, ensuring that the appropriated money is used exclusively for this intended purpose. There are no explicit offences, penalties, or civil/criminal consequences outlined in the Act for breach of its provisions. The Act primarily focuses on the appropriation of funds and does not detail specific sanctions for non-compliance with its terms. However, the legislative intent is to ensure that the funds are properly managed and used solely for the payment of war pensions, implying that any mismanagement or misappropriation of the funds could potentially lead to broader legal and administrative consequences under other relevant laws.
