Overview

Statutory Rules 1918 No. 145, made under the Defence Act 1903-1917, was enacted to address the need for financial regulations during wartime to support the Australian Imperial Force, particularly in relation to sick leave allowances. This legislative instrument was issued by the Governor-General in Council, acting on the advice of the Federal Executive Council and the Minister of State for Defence. The regulation specifically aims to provide financial support to members of the Australian Imperial Force who are granted sick leave upon discharge from hospitals abroad, ensuring that they receive an allowance when rations and quarters are not provided. This amendment ensures that the financial support system is updated to meet the changing needs of the forces during wartime.

Scope and Application

The Regulations under the Defence Act 1903-1917, as set out in Statutory Rules 1918 No. 145, pertain specifically to financial matters within the Defence framework of the Commonwealth of Australia. These regulations apply to members of the Australian Imperial Force, particularly those who are discharged from hospital abroad and granted sick leave, for whom financial provisions are to be made. This includes the allowance of four shillings per day when rations and quarters are not provided. The regulations also amend the War Financial Regulations to include additional roles and their associated pay rates within the Ordnance Unit, such as Armament Artificer, Blacksmith Sergeant, and various other roles within the Ordnance and Mechanical Transport Units. The changes reflect adjustments to the remuneration for these specific positions, ensuring that the compensation aligns with the roles' responsibilities and the broader financial framework during wartime. The regulations operate within the national jurisdiction of Australia and are applicable across all states and territories as they pertain to the Defence Act and its subsidiary financial regulations.

Key Provisions

The main operative sections of these Regulations under the Defence Act 1903-1917 include amendments to the War Financial Regulations, specifically concerning the financial allowances for various roles within the Ordnance Units (section 1) and the adjustment of wages for certain positions (section 2). Additionally, Regulation 24 has been repealed and replaced with a new provision that allows for a financial allowance for members of the Australian Imperial Force who are granted sick leave upon discharge from hospital abroad (section 24). These Regulations impose specific financial obligations on the Defence Department, requiring them to adjust the wages and allowances of certain personnel within the Ordnance Units, as well as to provide a financial allowance for members on sick leave. The changes outlined in sections 1 and 2 ensure that appropriate remuneration is allocated to roles such as Armament Artificers, Workshop Supervisors, Blacksmith Sergeants, and various other positions within the Ordnance Units. Section 24’s amendment ensures that members on sick leave are adequately compensated for the period they are not provided with rations and quarters. Breaches of these financial regulations, although not explicitly stated in the provided text, could potentially lead to administrative penalties or legal actions under the Defence Act 1903-1917. The exact consequences would depend on the nature and severity of the breach, but could include disciplinary actions, financial penalties, or other corrective measures deemed necessary by the Defence Department. The maximum penalties are not specified within the provided text, but could be determined under the broader framework of the Defence Act.
